Hi guys
just received a letter from the Abbey today regarding my claim.
I am currently going through the online court process, my claim has been acknowledged and the 28th day will be the 23rd Aug.
The letter today basically states that Abeey are asking the county courts to "stay" all claims- obs that means that they want all cases put "on hold" until the test case is heard (whenever). I really dont know what to do next- do I just go with this or do I continue as I would have before.... can anyone help or advise me.
Really appriciate this forums help- you guys have been brilliant!! :T

Keep going!
The banks are banking on us (pardon the pun!) being put off and giving in..please keep the faith!
Not all courts are agreeing to the stays, so you might be lucky....0 -
Thanks for your support I do intend to keep going- So do I wait until I hear dirctly from the court as regards to any "stay" ... ignoring the Abbey letter and obs if I hear no more after the 28th day, try to claim online a win by default ???0

Try to get in there first and get judgement! A word of warning though, I was elated the other week when I was awarded a judgement by my local county court and the bank should have paid by by 4pm today (they haven't) so my option now is to apply for a warrant, which I have heard the bank may be able to get a stay on the warrant (which seems bizarre to me!). However, not to be put off, I'm going to court tomorrow to issue the warrant!0 -

Good for you!
HSBC were supposed to settle my claim (judgement awarded in county court) today but they are playing stalling games, claiming not to have received the judgement papers, I have sent copies and even asked the court to - but no luck. My only option now is to go for the warrant.
Bring it on!!!!!!!!!!!!!!!!!!!!!!!!0 -

have you read the post today <TABLE class=tborder id=threadslist cellSpacing=1 cellPadding=4 width="100%" align=center border=0><TBODY id=threadbits_forum_102><TR><TD class=alt2></TD><TD class=alt1 id=td_threadtitle_529513 title="Hi, I've just returned from court and the bank has been given a stay!! I was told by the judge all cases heard would be treat the same as his Superior had made the overall decision not him - However, you could see that the representative from the banks legal team was so uninformed as she sat reading from a highlighted piece of paper requesting her 'Stay' and added the word 'Sir' after each paragraph - it was a joke!!. No wonder she asked if I wanted to discuss the case before we went in - which i politely declined - it was probably so i could tell her what was going on lol She positively had a kitten when i had my say - I said i thought it was disrespectfull that the bank had sent me a letter assuming a Stay would be granted - she flicked through her little file furiously looking for the letter when the judge said 'Its up to the Court, not the bank to decide such matters' lmao:rotfl: Just Back From Court - Stay Given but Legal Rep a Joke!

</TD></TR></TBODY></TABLE>she has been in court and showed that letter to the judge and he was non too pleased about them sending that letter out ,so if you get a judge that hasnt been told that it has to be stayed you may be lucky so take it with and quote her words
good luck hope it rules in your favour0 -
