Going to court next week (v. Abbey)

Hi all,

I have a date to go to court next week to reclaim unfair charges against Abbey (£1,000 in total).

My query is that Abbey sent me a letter last week saying that the action has been put on hold because they and other high street banks are waitnig for the result of the test case blahdy blahdy blah.... but when I callled the court yesterday, they say my case is still going ahead!?! So as far as i'm concerned i'm still going to go to court and see what happens. Has anyone else been to court even though they've received a letter from their bank saying don't bother? And if so, have you won?

    If you have an appointment with the court, it is for the court and the court alone to advise you if the appointment is cancelled. This maybe a general letter that they are sending to everyone, but in my view it is a simply a shoddy trick that may disadvantage you. If you fail to go and they turn up, the courts will take a poor view of you for wasting valuable court time. They will think the same even if both parties don’t turn-up.

    So, turn-up, take the letter with you and present it to the court suggesting that it might be considered as a party showing lack of respect to the court and even an abuse of process. The Judge may well agree.

    Hopefully, it means that they will not show-up and then you stand a chance of winning by default if the Judge decides to hear the case.

    Whilst I am amazed that these large financial service company’s continue to demonstrate unethical practices, it is good that people like you are making others aware and wise to what may happen.
