Do I need to still go to court

Hi. I am just wondering if anyone has any advice on court action re: bank charges (now that the OFT announcement has been made). I have followed Martins tips and sent off all the letters. I have basically got to the stage where I have sent off all the template letters and recieved an unsatisfactory offer of £200 (somewhat shy of the £2,900 I am owed). I returned their £200 cheque. However, my quandry is this, at no stage did I ever take the bank to court. The offer has been made (without court action) and I have refused it. The bank have written to me and said that the claim is now on hold until after the OFT test case and they will look at my claim again after the test case. I have always been close to the next step of taking the bank to court, but have just threatened them with court action. My question: Do I need to take my claim to court or will I qualify for settlement (depending on the OFT test case) because I have already registered my claim with the bank and they have made me a offer (which I refused)???? Can anyone help?
