Car crash advice

Hi, just wondering if anyone can give a little advice please. I was involved in a car crash on Friday. A works van pulled right out in front of me whilst i was driving on a main road, he was coming out of an industrial estate turning right. As a consequence I hit his front drivers wing with the front of my car. My cars a right off although his is repairable. We were both fully comp. My question is that he is saying i left my indicator on, I'm not sure as its all a blur. I've been to hospital day after and got cracked rib and whiplash. Who is liable for the crash, i'm worrie because ins. co have offered me a hire car but i don't want to end up paying for this myself. Any advice please thanks. I was travelling about 50mph hence my car is a right off.

    Whether your indicator was on or not, he should of waited till it was clear. Sounds clear cut to me. Any witnesses?

    Well, just let insurance sort it out. Pretty sure he should of waited for you to pass or make your turn. Is there CCTV covering the road as its a trading estate maybe?

    Drivers who leave indicators on are an annoyance, but I would never pull out in front of a car that was indicating UNTIL I was confident the car was slowing AND the "body language" of the car suggested it was about to turn (nose dipping and moving slightly out toward the centre line).

    This is basic stuff that everyone is taught when learning to drive and i'm pretty sure the highway code even mentions it (note "pretty sure").

    Insurance co will pretty much ignore the passenger accounts, as they're not impartial witnesses. I suppose your insurance co would see them as "hostile".

    You're right - Rule 104: "... be aware that an indicator on another vehicle may not have been cancelled."

    If you were on a main road and he has pulled out through a give way marking, then I would expect the insurance company to find him at fault, regardless of your indicator

    Depends on whether he was moving at the time and if stationary how long he had been there.

    He was driving a van and it wasn't his, I think we can pretty much put this one to rest :p


    Seriously though, the thing with indicators...... You have to think "Is the car indicating to turn into my junction or is it indicating to pull into the driveway just after it?"

    Or is the car driving through dappled sunlight and it just looks like it's indicating...

    (We think this is what happened when my husband collided with someone who pulled out of a side road in front of him.)

    I agree with the other posters - whether you were indicating or not, you had the right of way and the other driver is at fault.
