Bought 2 items from Ebay

I bought 2 tankinis (new from Next) from a seller, paid £30 for the 2. The label says they are both a 12, and only the picture (she has used a manequin) they look to be long fitting. Anyway, they have arrived but they are tiny, my sz 8 sister can just about get into them. I have emailed the seller but she says nothing she can do perhaps I should relist them. I normally would do this, but I have paid £30 for the two and I don't think I will get my money back if I re-sell them.

Is there anything else I can do, or should I just cut losses and relist.

  • start an item not as described dispute with paypal (assuming that how you paid), your seller telling you to relist them is in other words sticking to fingers at you, they are at fault here.

why is the seller at fault? I assume the item description was for size 12, and the labels are a size 12, so they are not not as described at all.
Makes vary in clothing size, Next I know comes up smaller (my daughter is an average 5yr old but needs age 7 from Next).
I sold a pair of trousers, BNWT, lady bought them and said they didn't fit, I offered a refund less post or said she was welcome to use my auction pics etc and relist them - why is this sticking my fingers up at her?? - she didn't want to relist as she wasn't a seller on ebay, so chose to return them (at her cost) and have a refund less post - in the end, it cost her almost as much not the have them. (and incidently, when leaving FB for her, I couldn't help but notice her purchases since mine were for the next size up clothes lol)

It is neither of theirs fault, if it was an auction and there were other bidders, personally I would ask seller if she could offer a 2nd chance offer and I would return them at my cost, or I would just relist them

Unfortunatly, when you buy items of clothing from ebay, it is not really any different to buying from a boot sale - if you bought something and it didn't fit, would you go back the following week and ask for money back? I never buy clothes from ebay unless I am 100% sure the make will fit first.

(if however they were advertised as a 12 and are labelled an 8, then yes, they are item not as described)
  • When I sell or buy clothes I go by the actual measurements of the garments and not by the size tag.

I agree with you totally on your post JulieBlake. The Seller is not at fault.

I agree, they are listed as size 12, the label says size 12, so they are as described, not the sellers responsibility to accept them back and refund the money.
You could relist them as a buy it now like how you bought them, at the same price to ensure you get the money back on them.

IMO though, on seeing the tankini on the mannequin on the listing, it does look very small (very narrow hip to hip on the briefs) and I'd have just thought that's a very small 12 and looked for something else.

Ive had MANY pairs of jeans from next and recently purchased a pair new with tags from Ebay, they were supposed to be a 16 but I couldnt even get them up my legs !! My sister is a size 12-14 and had the same trouble. I dont know whether them being a LIME range (budget) made a difference, i ended up keeping them but even to measure they came up small for a 16. (i will flog later ;) )

Could this be the case here ? Have you measured them ?

  • Distance selling laws mean that if you are not happy with them the seller has to take them back.Obviously Next have mislabelled the items or the sizing is just way out.It is however the sellers responsibility to check the acuracy of the description for the items they sell.

Unfortunately distance selling regulations are impossible to enforce in private sales on ebay.

    Just a quickie
I recently bought a size 12 item on ebay (not next) yes the lable said 12 but it was AGE 12 not size 12.
Just a thought and probably not very helpful ,sorry but worth a check at measurements for future reference.

Hi, thanks for replies....I already have 4tankinis from Next in a sz 12 and they are all perfect hence the reason for going for these. I think these have been mislabelled by Next, and sent to seconds store or something. I shall ask for measurements in the future!
