Refunding Postage

Hi,

I bought something online a couple of weeks ago (not eBay) but it was not suitable. I posted it back the same day.
The website's returns page states that £2.50 would be deducted from returns to cover the return postage.

I've just received my refund and they haven't refunded any of the postage and have deducted £2.50 from the item cost.
So from a £3 item with £5 delivery, I only got back 50p!

I've tried contacting them but all they'll say is they don't refund postage (no mention of this on their website) and there's an extra charge of £2.50.

Doesn't this go against Consumer Contract Regulations?

Yes it does ... seller must refund all initial monies paid, including initial postage. They can deduct an amount from the refund to cover returns postage (if they have provided a free returns process) provided this is covered in their T&Cs presented to the buyer prior to contract conclusion. (If it isn't then they can't even charge for returns either).

I mentioned the regulations to them and they're now refunding the postage.

I did some more digging on the site and there is a cancellation section that mentions the CCRs so they are aware of them.
