Nightmare Neighbour

Hi,

I'm after some information for a close family member who is in a bit of a pickle.

Their next door neighbour has been a real pain to them for the last 6-7 years, not rude or noisy but just intrusive, asking to store this in their garden (Although lately not asking just doing) and their family members parking on or blocking their drive without asking, harassing her husband to do things for them (he's a nice bloke but doesn't know how to say no).

About two weeks ago they found out that the neighbour is now spending some time at her majesty's pleasure for a serious offence and they are now so worried about when he comes out in just under 3 years that they feel that their best option is to sell their house.

I have suggested to them that as next door is rented they contact the landlord but they have no idea who the landlord is as the house was rented before the present people. I tried looking on the land registry for them but it doesn't come up. Any idea on what they can do other than sell their home? Its a bit run down but they like it and don't really want to move but they feel that they have no choice.

I feel bad for them and would like to help but im not sure how within the confines of the law.

Any advice would be welcome.
I have a lot of problems with my neighbours, they hammer and bang on the walls sometimes until 2 or 3 in the morning - some nights I can hardly hear myself drilling ;)

  • If they are going to sell their home, and they have a couple of years to do it, I don't see why next door's landlord is relevant to the situation in any way?

On what grounds exactly would you be contacting the landlord?

From what you have said, there seems no substantial reason why you should.

You say renting, is it council housing or private landlord, I'm guessing the latter. What do u expect him or her to do?

I'd say if he's away for 3 years, then rent is going to be right and eviction starting soon
  • I don't quite understand why they now feel the need to sell their house, they were happy enough to stay there when he was living next door to them so why now he's in prison do they suddenly need to sell? What are they expecting to happen when he gets out of prison?
If he's never been rude to them but just blocks their drive then I don't know why they feel so threatened, unless there's more to the story?
There's a good chance his partner won't be able to afford the rent on her own so will move anyway.

If you contact the landlord or make any kind of complaint then it should be declared when selling the house. If there is nothing formal then its just with their own conscience if they say anything...
  • I don't want to go into too much detail on an open forum, suffice to say that the offence is one that a young family wouldn't would living next door and they are worried about reprisals next door.

1: court rulings are public record, so anyone could know

2: as I said they will probably move before the 3 years

3: you didn't bother to answer private ll or council?

If anyone thinking of buying Googles the street presumably they will find local papers reporting on the case. Quite a few people are likely to do this when investigating the area.

I can think of one, ask LL to evict the tenants

    Wonder why !
Advice given on Assured and Regulated Tenancy, Further advice should always be sought from a Solicitor....
  • Him coming out "in just under 3 years" may not be the case. He could try doing "good behaviour" in prison and get let out earlier than that (maybe even in half the time he is supposed to be serving).

On the other hand, it could well be that his partner wont be able to afford the cost of the house on their own.

There is also always the possibility the partner is a "normal person" who inadvertently took up with this character and is not intending to take him back again after he emerges from jail. Does your friend think the partner is a bit **** themselves or just someone who inadvertently got caught up with someone like that and didn't really realise what they are like (ie now they do know what they are like they might refuse to have anything further to do with them)?
