Another seller who thinks its upto US to claim for loss/damages.

Was looking for this game and found a business seller has it.. But reading their T's & C's I got bored.

I like how he says its out of his hands once posted.

  • can his terms override those of paypal/ebay? , it is the person who posted the item to claim , not the person receiving it

    Its surprising the amount of listings i come across on a weekly basis with the same sort of terms, mostly private sellers but a good few business ones as well.

    It doesnt put me off bidding as i know if it goes missing i can claim,it also means a lot of buyers dont bid because they are put off by the silly terms so prices generally never get as high as they should..
  • Am pretty sure Ebay's rules prevail, whatever the seller may write as their "terms". It is annoying though, when people put things like "no refunds" or "its not my problem if lost in the mail, will provide posting proof" etc.
  • Theres a lot of liars and conmen out there buying on ebay as well as selling. I think its fair enough personally if the seller can claim proof of postage for the item. Ive got a mate selling a lot on Ebay and he tells me he gets it so often that they re claiming it never arrived..far too many for it to be Royal Mails fault. Sometimes its the postman bunging it in a a green box by the door and it gets stolen. The Postie is after lightening his load and keen to leave parcels anywhere he can. Anyway human nature rules and theres a good percentage of our population as bent as dogs hind legs buying as well as selling

    Its the sellers responsibility to claim if an item goes missing, regardless of what their terms and conditions are.

    It doesn't really make any difference. If a buyer claims non receipt and all a seller has is proof of postage then the buyer wins the claim, Paypal refund their money.

    The proof of postage is there to assist the sender in dealings with the post office not to dump the responsibility on the buyer.
  • So all a buyer has to do is claim he never received the item and would always win the claim ? That all seems one sided in the extreme. Surely in any dispute, Ebay could check, ( that will be a teenager in a rented bit of a call centre) if they could be bothered, if the buyer had tried that con in the past and would rightly throw it out on the grounds of it being too unlikely of Royal Mail losing post twice.Its got to be pretty rare that stuff simply "gets lost in the post "

    Not unless you sent it tracked

    Its not that rare stuff gets lost in the post, ive had two items in the last month that have got lost
  • If you feel the item is!NOT!AS!DESCRIBED I will accept a return and pay half of the return postage.! However PLEASE CONTACT ME FIRST.

    So if an item is not as described, he will cover half of the return postage costs.
    That's big of him.
