Letter from Lowell

I had a bank account years ago. Had a £300 overdraft facility. Lost my job 7 years ago was unemployed for 10 month. The bank kept adding charges to the account till it defaulted with a balance of £800.


Got a letter from Lowell saying they were looking to collect. Wrote to them saying the debt was statute barred (the default date was July 2008). They wrote back saying it wasn't statute barred as I had made a payment on December 23rd 2009. Obviously I had better things to spend my money on 2 days before Christmas and I know with 100% certainty I haven't made a payment and that this is a blatant lie.


Since I sent the letter saying it was statute barred they have started sending me messages and phoning on a daily basis. What should my next step be?
I have enough money to last me the rest of my life,as long as I die next Tuesday.

    So an OD facility will not attract any paperwork other than bank statements.
    You need to re-iterate the SB defence, remember, they have to prove you made that payment, its not up to you to prove you didn't make it.
    Simply ask them to prove what they are telling you, or to jog on and leave you alone.

    It is statute barred. The legislation is there for a reason, to stop recovery action from continuing in perpetuity. If they had wanted their money, they should have commenced proceedings earlier within the proscribed timescale.
