Not sure I have a case - Parking Eye fine/invoice

Hi,

I've had a PE fine £50 pay now by today or £85 by 13/09/14. I received this and a reminder whilst on holiday.

We went to a Community Event and the Council car park was shut. An official looking gentleman in a high vis jacket told us we would need to park on the retail park. In fairness he could have been anyone. On entering the car park on the left was a food market so I glanced at that and didn't notice the signage. We parked, shopped, visited community event, ate, retuned and went home.

We stayed 3hrs 40mins with a three hour allowance. On returning we noticed the signage but were unsure of what time we had arrived and I had to cross the car park to look up and see it (my eyesight isn't the best) but the signs clearly state 3hrs.

I'm a bit peeved we were told to park there for an all day event and it wasn't as if the car park was that busy as there were spaces at 12.48 when we arrived and quite empty at 16.28. Hubby rang the Council as it was there event and their Official but they aren't interested as it's private :-(

I have already missed the cheaper fine as they may have issued it on the 16th but it didn't arrive until after we left on 22nd effectively giving us a week.

I've read other threads but with CCTV images, the fact I did stay too long albeit in ignorance, signage, I can't prove we were told to park there, the Council don't want to know is it worth appealing?

If I do appeal do I not tell them who was driving as the CCTV doesn't show the drivers face just the number plate.

Any opinions or advice would be greatly appreciated.

    Don't worry if you don't think you have a case there are always things you can raise in an appeal.

    As happy said, you do have a case, read the "Newbies" thread under parking, fines. there you will find a template letter to send to PE (Private Eye). This appeal will naturally be rejected by PE, inwhich case you then do a second letter to POPLA (Appeals people). I have just completed the process myself. I stayed 40 minutes longer in a supermarket carpark, which resulted in a parking fine in the post from PE.

    read the newbie section, and past the letter you are going to send to PE here

    First stage soft appeal to PE. They will reject and give you a POPLA code.


    Follow How to win at POPLA.


    Do not disclose who was driving. Always write in third person as the registered keeper.
    Remember at all times PE are only conducting a money extraction process. These charges are unfair!
    Follow what the experts tell you on this forum and you will win as sure as night follows day.

    Remember mitigating circumstances are irrelevant. Pop back and ask any further questions when you have read and inwardly digested the newbie thread, especially posts 1-3

    Unless you smashed up the machines, broke the barriers and caused £85 damage, you have an excellent case. If it is a free car park, even better. There are a few hoops through which you will have to jump, but it is a useful learning experience.
    You never know how far you can go until you go too far.
