Another Pcn Southampton British ports authority... Confused...

Hi all,
This car park comes up a lot.. I'm abit confused I'm the keeper of your car. my bf was driving and has appealed on the grounds the signs were confusing and two other people in the car park also didn't understand. I assume as he has appealed they know he was driving.
After researching more this am I've found lots of information on this site. It says they have no rights against the keeper but they already know wasn't driving.

Do I appeal again saying they have no right as they are not the landowner. They have sent a popla appeal on the 14th august...
Any help would be greatly appreciated. I have read the stickies and notes, but am still confused.

    no need to be confused, just use one of the recent appeals to popla for that site, also citing its not relevant land so POFA 2012 doesnt apply

    you should also be complaining as RK to the DVLA and to the BPA too, due to it being not relevant land

    they could pursue the driver, which is why you do not name the driver in these cases, but it seems he may have dropped himself in it

    you could use this not relevant land as a single point appeal, but only if you know what you are doing and I would not recommend that action unless you are actually willing to "chance it" like benefit-master did, and won

    Unfortunately you can no longer use pofa12 regarding registered keeper liability as the b/f (driver) had already appealed.

    As he has had his rejects and got a POPLA code go to post 3 of newbie thread and draft a POPLA appeal based on the usual points of no GPEOL, signage, landowner authority and ANPR.

    For future reference it is usually better to wait for a NTK before appealing any ticket.

    P.E do not seem to be contesting forum based appeals so he won't have to pay anything.

    it would therefore help if we knew who has actually received the NTK or pcn or popla code

    if the driver has the pcn and popla code in their own name, the RK has no further input

    if they are pursuing the RK despite the driver appealing , then its a muddle, but the person who has the popla code in their own name should be appealing to popla

    frankly, I am now confused due to the driver getting involved instead of leaving it all to the RK ,especially as the land is not relevant under POFA 2012

    seems to be a confusing day on here today for some reason , possibly due to a lack of good info or people muddying the waters as in this case , especially where POFA 2012 RK liability didnt apply

    Depends what bf said in his appeal - did he really give away who was driving? And anyway all PE cases on here are won at POPLA stage anyway so even if he has thrown away the slam-dunk winning appeal point about 'not relevant land' he'd win on the other standard POPLA appeal points! Only the person who was sent the rejection letter can appeal to POPLA - so that's not you is it? It's your bf's POPLA code surely, they replied to him?
