advise please bought phone but sent different one

Hi guys

Bid and won a mobile on the behalf of my brother in law, through my ebay account. Paid by paypal. The mobile that I won was black in the photo but the one sent to me is silver. Also the imei on the phone and box do not match even though the seller said that it was the original box.

here is the no

120140469180

I have emailed the seller to ask him to explain why I had been sent a different mobile and asked him to explain why the imei no does not match.

waiting for his reply...

what do you guys suggest...

Luckly my purchase is covered by paypal protection upto £150.00.

the fact that the IMEI numbers dont match rings alarm bells straight away. Id see what he comes back with, but gut instinct would be to return the phone for a full refund.

File a significantly not as described report with paypal if he is uncooperative!

    THE SELLERS REPLY WAS

    [FONT=Arial, Verdana]Hi

I'm sorry about the colour of the phone looking back at my sale image you are correct, I've sold a few of the black and silver ones so i must have mixed the picture up. The phones were given through a company and although they are as new they have been removed from their boxes and hence not put back in their correct ones.

If the colour is an issue i can refund the money and you can return the phone.

    Sorry for any inconvenience caused.

I have told him that I want a full refund and for him to arrange collection.

    Maybe maybe not.

But you will have to return the goods via a trackable means to ensure that you get a refund. And paypal will insist on that anyway if you put in a claim so you might as well just send it back now before this get's too ugly.

Asking seller to arrange collection will not be an option.

Could be a genuine mix up, esp if he did buy a job lot.

Fact seller is willing to give you a full refund sounds good. And as allready been said, you will have to post back (be best for SPECIAL DELIVERY)

Might it be an idea to also take the imei number of phone you are sending back, just in case he has a faulty one kciking about and decides to 'swap' them.

mmm maybe but in he listing he states he is selling this phone due to haveing an upgrade, etc. It doent fit too well and the fact the imei no dont match bothers me, so I gonna send it back.

seller has refunded full cost plus an additional £6.00 for me to send it back via sd. Paypal have deducted £4.33 off. I didnt think refunds had fees. Also the seller wants me to send it to his works address which is not his paypal address. Didnt think it would be wise. Would I be covered?????????????

    advise again please guys

It sounds as though he has used 'send money' and not 'refund'. There would be no fees if he had simply clicked refund. I guess it's up to you whether you want to go through the palaver of refunding his payment to you, and asking him to refund you (again)!

    I wouldn't, personally.

Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

to be fair it does sound like he is trying to be helpful, these things do happen, i was trying to send out a pair of assault boots to a wining bidder, and due to my missis being dead helpful and efficient, she posted out my best parade boots to him instead, end result he had a pair of highly polished best boots for work, and i had a pair of non shiney boots 2 weeks before a parade. i did exactly what your seller has done, except i sent him the boots he wanted and asked if he wouldnt mind posting mine back. to be fair the mistake had been noticed our end when i looked in the wardrobe and asked why the boots were still there, before he even opened his parcel.
