Amazon

sold the mp3 play i got using the MBNA card (they sent a pink one out)
I listed it on AMAZON and the only description they had was Sony mp3 player black, underneath in the sellers comments I stated that it was THE LADY'S VERSION<<<<<PINK>>>>>>>> !brand new!.

The buyer is now trying to say I mis-sold the ITEM who is in the wrong?

Help needed coz I am only new to AMAZON and don't want to seem like a rip off artist.

    You are, you listed it under Black when it was Pink. I report loads of sellers who do this (most do it intentionally). There will be a listing for Pink ones or else depending on your account you create.

    In this instance you should either refund in full (inc return P+P) or offer a decent partial refund (if refused back to refund) with lots of grovelling.

    but the problem is AMAZON didn't list the PINK version which I searched and tried to add it but it wouldn't accept the product no (no product found with your descrpition ), so the only thing I could have done was use the black description then clearly underneath state it was the PINK version which i did. here's a link to the page............

    by the way the buyer was a woman, so I didn't think she'd have a problem with the PINK one.

    if the pink has the same barcode as the black then you have no option, if the correct barcode has been used, many manufacturers use 1 barcode per item, regardless of variations, then the correct way according to amazon is to list a condition - and put in condition note pink - you could also add your picture

    some catagories do allow variations, (never sold in that cat so not sure),

    The buyer is entitled to a full refund upon return of the item regardless of who is at fault, request that they use at least recorded delivery (although special would be better) and refund upon return.

    You dont HAVE to refund return postage costs but in this case it may save you a negative you dont need !! (paypal cheque etc)

    Yup the pink does exists as a seperate product on Amazon so it could easily be said that you offered yours for sale against the wrong product. No choice but to refund and try to avoid a negative. If the buyer starts an A to Z claim against you they will win.

    You are making a lot of assumptions and you know what that means AS.S*U*ME!!.

    If they don't list it then you either don't list or if you account status alows you add a new listing. If you were being really cheeky then you at least have the sense to confirm that the buyer wants a pink one.

    List under the wrong category be prepared for a neg, you are in the wrong so please cover all the buyers out of pocket expenses etc and grovel hugely and you might if lucky escape a justifiable neg.

    PS Most of the few negs I have had are from folk who don't read a listing and you will be surprised at the number of that don't read it. You are also covered under the Sale of Goods Act and they can return an item up to 8 days later for no reason whatsoever if they so wish.

    Amazon is not like ebay..Amazon do not allow a seller to list something in the wrong area, if the colour stated was black then you MUST sell the black one.

    The lady has just contacted me and apologized, she didn't read the description and has offered to return it unopened and at her cost.

    I think that's acceptable haven't got a problem with refunding someone if they admit they didn't read advice notes that was posted

    ...........and by the way the Pink version has exactly the same serial number and bar code, so when I listed it at the time it kept coming up with BLACK. Exactly the same spec just the case was pink.

    Not like I sold a 512mb in a 1gb cat for the same price.

    Anyway on a less negative side (Some men Like the Colour PINK)
    I think I'll relist it on EBAY easier to use!
