help! paypal not given full refund on ebay purchase

i purchased 4 single items from the same seller on ebay, he packaged them up and sent them, they never arrived so after waiting the allotted time i reported this to paypal they oppened a case, after the the alotted time again they decide to refund me £24.50 and not the original £92 that i had paid.
tried to phone paypal, well if youve tried that then you will know its impossable, emailed them and had no responce yet.
the seller has just gone to ground on this and wont comunicate.
any ideas as to what i could do?
if i could get his adress id take him to court but i dont see where this information is, it used to be on ebay years ago,but i cant find it now

Always fund your paypal purchases using a credit card. If you have done this claim against your credit card, not against paypal.

no they transferd the funds from my bank account, paypal say they paid only £24.50 cos thats what he had in his acount.
wheres the up to £500 paypal protection?
trying to get his address so i will take him to small claims.

Did the auction listing display the PayPal buyer protection logo? I'm assuming that as you only received a partial refund of £24.50 that it probably didn't.

My customers are guaranteed up to £500 protection - they would take the money from my account, whether there were funds to cover it or not, that's what buyer protection is all about. The item in question could not have had that level of protection on it.

yes i wonderd about this, there is still a paypal protection logo on the buyers page that i got the item from, just been reading the t&c`s it gets better:

General. PayPal’s Buyer Complaint Policy covers goods that are purchased and not delivered, and goods purchased on eBay and paid by using PayPal that are “significantly not as described”. For payments relating to eBay transactions, this Policy may apply if the buyer complaint is ineligible for coverage under PayPal Buyer Protection. Buyer disputes must be filed within 45 days of the payment and, even if the buyer’s claim is justified, the buyer will receive a recovery only if there are funds in the seller’s account. RECOVERY OF YOUR CLAIM IS NOT GUARANTEED.


and ebays protection is worse they will pay you upto £120 per item but charge you 315 per item, not bad, uless like my items where all £20 so i would only get £5 for each item after there charge, what a rip off this is turning out to be.

what does a paypal buyer protected logo look like? there is a paypal buyer protect logo near the payment section of the sellers page but that could just be an advert its very missleading.

I thought that if a listing qualified for PayPal buyer protection either £150 or £500 this meant that in the event of a claim PayPal debit the sellers account for the amount in question, in your case £92.00. I assume that the seller only had £24.50 in their account but I assumed that PayPal would send the sellers account into a negative balance in order to pay you.

The eBay buyer protection programme no longer exists.

When did you actually buy this item was it before the new paypal buyer protection policy came in?
And what version of paypals terms and conditions are you reading. A new once came out on the 2nd of july.
If your reading this version then your reading the wrong bit "PayPal’s Buyer Complaint Policy" in the new T&C's refers to non ebay purchases.

Ebay purchases are covered under "Buyer Protection Policy".

If you purchased before the new paypal policy started then you won't be covered and you should be reading the previous paypal T&C's.

If you purchased after the policy started as far I can tell you should be covered for all transactions under £150 regardless of the seller having sufficent funds.
