Help!! Seller won't refund money when he promised

Can anyone advise me on this situation?
I won a pair of trainers on ebay on 18th april 2007, the seller did not have an paypal account so I sent a personal cheque as payment and received the shoes a few days later. After the first wear the stitching came apart, I contacted the seller who was very apologetic and offered to exchange them for me. I liked the trainers and did not have a problem with this. An exchange was made but when I received the new pair of trainers they too had a fault.
I contacted the seller and advised then that I was not happy as the trainers were faulty when I had not even worn them, i requested a refund. I received an email back from the seller saying that if I wanted I could keep those trainers and he would send me another pair free of charge but if I really wanted a refund he would give me one. I emailed back stating that I wanted a refund and would post the trainers back. I posted these trainers back on 21st May 2007 before I went on holiday, I have just returned and have still not received a refund. I have send constant emails to the seller with no response. Due to the timescale I cannot open an dispute, but I have checked the sellers profile and he is still selling the same trainers, among other expensive items and still has not got a paypal account. I know he must received my emails as he has auctions open at the moment.
I was considering contacting ebay's safety team, but am unsure. When I dealt with this seller he was fairly new to ebay but since then now has nearly 50 feedback all positive.
Has anyone got any advice please?

Did you send them back so they were trackable? Do you know he definitely received them? I'd suggest calling the seller, get details via Find Contact Details.
You can also try contacting Ebay although as you say you paid by cheque there isn't a great deal they can or will do.

I sent the trainers back by recorded delivery both times. I've tracked the item and have seen proof that the item has been signed for.0
