  • Contact them in writing. Explain that you would like all communication in writing. Make an offer of payment, make it realistic and honest. Complete a financial income & expenditure form that backs up your offer.

Don't ignore it, you owe the money, it is up to you to repay it. Fair enough, you can't pay it all in one go, but you still do have to pay.

NB A letter before action is generally sent before a referral to the small claims and a CCJ. You really ought to try and avoid this.

If you took out the card before April 2007, send them a CCA request. Without the signed original agreement, court action can be defended easily enough.

It's best to know where you stand with companies like this.

I have had dealings with Fredrickson on a number of occasions in every case that they have threatened to take me to court the ultimate end of the situation has been referred back to the original company.

Fredrickson international is owned by Bryan Carter LLP.

I sent an F&F to them in January this year which they declined and told me to contact the office within 7 days or again they would pass the debt back TalkTalk.

Only the owner of the debt can take you to court, these people are just a DCA instructed by capital one to recover the debt, in reality there is nothing much a DCA can do to you, they can issue a default notice, but may of done this already, is your credit worthiness important to you ? if so write and offer them what you can afford, if not, they are just 3rd party interlopers and can be ignored should you wish to do so, but you will find the debt gets passed to various other DCA`s who will, in turn, ask you to pay up, if its a small debt it will never go to court, will just be passed between DCA`s till either you pay up or they get tired and move on.
