NHS having to reapply for my own post

rooster
My trust has combined with another trust and we have all been told we will have to rotate across the two hospital sites. Not everyone is happy with this (just a few) we have been told that unless we all agree then it will go to consultation and we will all have to reapply for our current posts. There is no TUPE protection in place for those objecting to rotate and vast majority accept we will have to rotate and are willing:
My question is it legal to force us all to apply for our posts if only a few people do not wish to comply with management?
If I was unsuccessful in my applying for my post would I be made redundant as the post would still exist and would I have a legal case against the individuals who have forced management to make us apply for our posts.

What does your current contract say about locations.
Looks like they want to change contract to have more mobility, this would be a different job.

Consultation is about seeking views of the workforce and amending plans if necessary, should any valid suggestions or opinions come out of it. It doesn't mean, as far as I know, that the employer has to go along with what staff want and it's not reasonable (or likely) to get every member of staff's agreement. Ultimately they could simply say that's what's happening and anyone who doesn't like it should go.
I don't see that there would be a valid requirement for staff to re-apply for their own posts unless a) there will be more staff than posts available as a result of the changes or b) they want to significantly alter job descriptions. Are you in a union? They'd be the best place to start, or give ACAS a call.0
