If you notice my template letter above, it doesn't actually name the driver, it just says who is responsible for the vehicle on that day, and that is all it needs to say
When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

Yes.............and I quickly edited/removed my comment about not naming the driver. I'm wary of giving advice when I'm a complete newbie to this subject.;)

Thanks guys, I'll get the letter posted on Monday.

Sorry if I seem a bit abrupt at all, I'm nearing the end of a very difficult pregnancy and this is not what I need right now!

in that case the EQUALITY ACT 2010 may well apply and assist you in this

my advice is use the details posted by stroma above and obtain the NTD in your name, then use this forums assistance to beat them at popla, which is what would have happened had you posted after the NTK arrived

all is not lost and you can easily beat this at popla

    good luck

ps:- you can see here that the more background info you give, the more help you can receive

''On 16 Sep this year I got a PCN for parking in a private car park. The fine was from CPP and they have sent 2 letters so far asking for payment of the invoice which we have ignored.''

Can you tell us, before you post any letters, whether you actually had a windscreen PCN or whether this was an ANPR postal PCN? What was the alleged contravention?

You should not assume the 'clock can be reset' if there was a windscreen PCN; it can't. I tend to agree with Robin Friday because that pink letter is standard for this mail scam and personally I would consider ignoring the whole letter chain seeing as it matches exactly the ancient and well-documented pics here:

    https://forums.moneysavingexpert.com/discussion/2329119

Remember you do not have to respond. With this letter chain, personally I would not, unless you get a real LBCCC which differs from that link. I suspect you won't.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I would endorse Coupon-mad's advice. I got the pink letter in September 2012 threatenng court if not paid in 7 days. Absolutely nothing since.

CPP do seem to be the most toothless of operators, based on forum feedback.

  • From I.C.C Legal Services website:

    http://www.industrialcredit.co.uk/parkingfines.htm
Parking Charge Notices have been a useful deterrent against motoring offences for many years and up to now, relying on time and investment from organisations to follow up to a positive conclusion. For these and other reasons, ICC Legal Services realised that many of these collections (despite a number of reminders to the offenders), do not take place. We also realise that the revenue achieved from these outstanding and mostly overdue penalties could be put to good use within the community that many of these organisations serve.
    :rotfl::rotfl:

Priceless -almost as good as what the PPCs claim their car parking management skills are.

    and:
This process takes the form of a pre-action Final Notice Letter to the point of payment within a defined period of time and then a decision to Issue Proceedings on the remainder or, abort and close the action based on legal or commercial grounds.

No they can't -they are not solicitors - just debt collectors.

Even if it's a ticket on the car the RK has a right under pofa 2012 to name the person responsible for the vehicle. It could be argued that there was no ticket on the vehicle for example. Not that I'm saying to lie. The point is though it's an option and it's one that could reset the clock.

It doesn't reset the clock at all though where there was a windscreen ticket (even if none was seen, it was removed, etc.). The driver has missed their chance to appeal unless it was a postal PCN. IMHO there's no advantage in naming the driver especially when this is the same pink letter that's been ignored for five years or more.
