had EH and LL out yesterday

bit of an update (couldn't find other thread) my LL put my deposit in a scheme on the 2 December 2013, I have been here since 26 January 2013, got paper work this morning
have spoke to the DPS people and have to put in writing that I want it frozen due to a on going dispute
he has put the deposit in a scheme after I asked him where it was and he said my bank account, said that's illegal, and he panicked
had him out yesterday with EH and our solicitor, at first EH refused to inspect the house as my solicitor was there, till she said, if you are refusing to enter the property then you must declare it unfit or do the inspection, both him and my LL where panicking then as they said in there own words "I didn't expect you to have someone here who knew the law" in end inspection was done, usually damp, mould, needs a new roof, needs fans fitted, needs dry rot fixing, humididty test of 68.2 and a damp test of 140, (no Idea what this means, as EH wouldn't tell us what his finding where until he did the report, I seen bits when he was doing the inspection) any way there are hazards that he has to fix
all the time the EH was doing his survey, the LL was argueing with me, and solicitor, he was saying, he said I (me) would fix everything in, thats why it took him so long to fix the boiler, also 4 plumbers who condemned the boiler and give me paper work, told him it was fixable, he then said the house was perfect and every other tenant was happy, (no ones has lasted more than 6 months) and had proof that the property was in perfect condition before he let it to us, then a few minutes later is saying he never inspected it before we moved in,
he then called my misses a liar over something, that he said he would do
his builder has been on stand by for 2 weeks to come and fix the house, and he would have to get a loan to fix the house
any way best bit was he said he had a letter that we sign stating that we would take the property in any condition as we where going to be homeless, he had it on him just wouldn't produce it, these arguments went on for over a hour, till he said "I need legal advice don't I" and walked out

also his idea to stop wardrobes getting mould, pull them about a 1ft away from the wall0

Good to hear the update!
Sounds like its a good thing you brought the solicitor along and I'm glad you finally managed to get the environmental health guys to come out too. I guess you filled in all the correct forms eventually
I'm really hoping the solicitor talked some sense into you regarding either paying the rent, or going down the correct route of withholding rent via the procedure on the shelter website.

The landlord is entirely correct to suggest that you move furniture away from walls to increase airflow behind them and prevent mould growth caused by condensation.
Infact the leaflets produced by what used to be DEFRA offering guidance on dealing with mould caused by condensation specifically mention doing this as a preventative measure.0 -

The landlord is entirely correct to suggest that you move furniture away from walls to increase airflow behind them and prevent mould growth caused by condensation.
Infact the leaflets produced by what used to be DEFRA offering guidance on dealing with mould caused by condensation specifically mention doing this as a preventative measure.
the stuff wasn't flush agains the walls, he wanted a ring of 1 ft space around the rooms, that why he wouldn't have to fix the walls, so I could only use the centre of the rooms0 -

any way spoke to EH, as I wanted a copy of the report, they wont give me on due to data protection act, but did tell me what was up with the house
is there any way I can make them give me a copy
as I got hold of the EPC report and it had a rating of 1, and was recommended to replace the boiler in Jan 2011, due to it being so old and inefficient0 -

With all due respect...
To get a rating of '1' the house would have to have zero heating, be full of holes etc.
I think what you actually mean is that the house is rated G, which is (1-20).
You also need to appreciate that an EPC is full of assumptions, assessors make assumptions on what is likely for that type of house, not what is actually there - they don't, for example, check whether there is cavity wall insulation.
EPCs will also be full of standard wording which - unless the boiler is brand new - will often include guidance on replacing the boiler because this is something the government are particularly pushing.
What I'm saying is that this is extremely vague and 'cover all' guidance and certainly isn't a personalized recommended scheme of works for your particular property.0 -

I very much doubt it - since you are not the owner of the property.
Your landlord, as the owner, might - or he might just be given a list of jobs that need doing and, probably, some timescales in which they must be done to the satisfaction of the EH inspector.0
