Ending a tenancy agreement mid term?

Some advice here would be really appreciated.

I moved into this property 2 months ago. I really hate it and would love to move. The main reason for me is the traffic. The landlord and the old tenants told me that they hardly noticed the traffic and it is only busy during rush hour. In fact 8000 cars a day pass my front door and 9 times out of 10 it is impossible to park anywhere near my house, which is a complete nightmare with a baby and shopping. I can't open the windows because the smell of the car fumes. I realise that I should have researched the area first and that I have no one to blame but myself which upsets me even more.

My landlord seems really nice but I wondering what the best one to go would be about moving out before my 6 months tenancy finishes. Has anyone ever done this? If I found a new tenant myself would that help?

I would be grateful for any advice

  • You are contractually bound until the end of the tenancy (As you know). All you can do is throw yourself on the mercy of your landlord and hope for the best.
    Normally if a landlord agrees to an early surrender you would pay any costs with reletting (ie advertising etc ) and the new tenant has to be acceptable to the the landlord. The landlord can impose whatever restrictions/penalties they like for leaving early but that is the standard terms.
    It is up to you to negotiate.

    Depends if you have a break clause but unlikely on such a short AST.

    IN any case you would still need to give 2 rental periods notice while within the contract or one on a SPT.
    You are already 2 months in so another 2 months notice you are already almost there. I wouldn't bother unless it is so bad that it affects your health , I know you hate it but 6 months is over quickly, just remember to give notice before the start of month 5 although legally you don't have to do so , you can just leave at the end of the AST but it is good to do so for references etc.

    You can ask.

    A mutually agreed Early Surrender can be arranged.

    Normally a landlord would only agree if you pay his extra unexpected costs (esp after only 2 months).

    This is commonly one or more of:

    * re-advertising
    * letting agent fees
    * legal fees for new contract
    * Inventory clerk fee for new tenancy
    etc

    Negotiate on these, and whatever you manage to agree with the LL, get it confirmed in writing so there is no misunderstanding.

    * rent between your exit and new tenant's arrival
