Parking Eye advise needed court summons issued to me

i only received the court summons and none of the previous letters i should have had like debt collectors or pay before 28 days etc.

i have appealed to the courts and asked for court case to be moved closer to me in Sheffield and also stated i am willing to pay for a day pass etc but not the fees PE are wanting as it OTT .

i have also appealed to PE who have replied and want to proceed further to court and sent me pictures and time and date of car entering and leaving the site which i never had before
12/12/2012 19.04pm - 22.22pm 3hrs 17mins total 1hr 17mins over stay.
Also my daughter was driving but i am the registered keeper hence it all in my name.
PE also attached large pictures of warning signs from site and also printed cases gone to court where PE have won but think it scare tactics .
As i state my daughter did wrong and we are willing to pay for day pass plus court fees and i offered this to the court and PE but PE want to take it further .
So i welcome any advise in my next step please .

What date is the court summons and when did you receive it?

court date end of october 2013 but appealed and asked for court closer to Sheffield as over 2hour drive away for Northampton
sent reply back to court and parkingeye on 19th september 2013

I have just received all the pictures ,times,dates etc which i never had in the past .
The only letter i have had is the one to be taken to Northampton county court on which i replied to yourself and the county court on the 19/9/2013.
on this occasion my daughter was driving the car and i am just the registered keeper.
I believe because of this your have not complied with pre acton protocol and wish to ask for a popla code as i was not given 28 days because i never received any letters about this case??? and also i was not the driver at this time or event and you are now in a position to challenge the driver - xxxxxxx xxxxx at the same Address as above.
As again i will offer to pay for court fees and a day pass parking fee as no great loss of £85 at 19.04pm - 22.17pm was achieved 1hr 17mins over stay .

What did you send as your defence?! :eek:

I am concerned you are going to be mugged because PE turn up mob-handed! Surely this has already been allocated to Sheffield earlier on when you got your Allocation Questionnaire?

I stated that my only letter i have had recieved is the court summons and new nothing about it and it took since dec 2012 till now and i want to move case closer to Sheffield and i offered to pay the court fees and a day pass to the courts and to PE but PE want to proceed to court on letter i got on Saturday 19th October.
so i have emailed PE again this morning with the below.

Yep but what exactly have you sent to the court as your DEFENCE?

And when did you get those court papers?

i got court papers on 19th September and replied on same day via email and letter.
told the court it was my 1st letter and needed more info as nothing arrived about the case in the past and also asked to move the case closer to Sheffield
the court replied that they had notified PE and await reply back,also i offered to pay court fees and day parking fees as £85 was extortionate and loss of earnings was only 1hr17mins and i could understand if cars was queuing to get in and out of the car park,but my daughter says it was nearly empty.
i stated this to the court and PE.
PE sent letter on saturday saying still proceeding with the case but did stick time,date,pictures in same letter.

No wonder they want to proceed with a hearing if you haven't submitted any real rebuttal of their claim nor any defence points to speak of; sorry but they must be rubbing their hands with glee. Oh dear.

You are not going to win saying the charge is extortionate and the car park nearly empty. Have a look at Space Cowboy55's thread where he posted a draft of his defence yesterday. You are cutting it fine to get any sort of decent defence sent to the court and to PE!

Not such a scare tactic in your case it seems...sorry...! I really hope you can 'get in gear' in time to defend it - but if you didn't send a skeleton defence at the time you got the court papers you may not be allowed to submit new robust defence evidence this late.

Are you for real, this does seem something like a troll thread if you really have allowed it to get this far with nothing in your defence. Very naïve if not.
