thank you for the info it was a confiscation order not tax so still a gov issue weve tried to sell the home but like most sellers there arnt any buyers been disabled mobility and cancer a flat on the tenth floor is a no no0

Ch*ist, couldn't get any worse its not HMRC but a Confiscation Order (CO) as a result of a POCA issue .... no lender, even if just a straight remortgage, would go within 10 miles of this due to the underylying conduct issues and court conviction (which must be revealled in any financial and insurance application if requested, until classed as spent under the Rehabilitation Act 74)
Your mobility and cancer condition really have nothing to do with selling the flat to someone else - unless its been so heavily adapted (hard to see in a flat) that it would require a rip out.
For a sale price below market value, enough to satisfy the 45k, CO you have recd, it will sell - and thats what I suggest you do.
Lets be clear, this won't go away and you may find that in order to satisfy the order (even if the property itself wasn't confiscated), the crown will pursue and probably (due to the nature of the debt) obtain a possession order - which will take out of your hands any control over the sale price achieved.

thank you for your help they have ajourned it for two months we do want to sell it has its a house with stairs and it has been alterd for a disabled person we are trying to sell it but its not easy when no one can get a morgage weve been the cab who were a great help has they allways are i understand iv to pay this and i did try to get a charge put on it but they refused again thank you for your help0

Hi ktate,
A Charging Order is simply a charge, which is satisfied from the proceeds upon sale, whenever that may be, which is why they are reluctant as their view is the crown shouldn't have to wait or accomodate your personal requirements in satisfaction of a criminal judgement. This is different to an order of sale.
Speak to Shelter whom may be able to guide on rehousing options.
