Moving into ex's property temporarily, he is moving out, is this legal?

you are all being so helpful, thank you so much.
yes, he has parental responsibility, he is named on birth certificate, we lived together as a family until it became apparant that family life wasn't for him. daughter was about 18 months old at the time. despite everything though, he's a good dad and we still get on well as friends.
ex would not be entitled to much ctc/wtc, so it wouldn't be the sensible option to change it over to him. he earns a lot more than me and i would really struggle to bring my daughter up without tax credits. this is something that will hopefully change when she starts school though as i can work full time and won't need to rely on tax credits anymore. we claimed together when we lived together, and although only received a little, it didn't matter as ex paid all the bills etc...
but how do i prove he's moved address if they ask? as it's only temporary, all bills will still be in his name. seems too much hassle to change everything over for 4 months? he'll be living in his own property that his cousin rents from him. surely the only proof will be that he goes on the council tax bill with his cousin, or maybe puts a utility bill in his name? he will be informing HMRC that he's moved in with his cousin temporarily too.0 -
If you want to claim CTC etc, you will have to change all the bills over to your name from the entry date; otherwise you willc ertainly have the customer compliance officers on your case and a large repayment is a probable outcome. If you've have not made a mistake, you've made nothing0

will they instantly know that it was ex's home and assume we are back together?
so, i'll have to change all bills over, council tax over etc... even though it's only for 4 months? ex will have to register his council tax with his cousin and come off the one i'll be moving into?
then we'd change everything over again in May? it's so much hassle!0 -

Yep, if you want to keep it all above board. It's not so bad really, 6 phones calls. Take you an hour maybe.

DWP (is it dwp who does child benefit - hmm i dont remember)
BT/Sky/whoever does the phone0 -
You have two choices really, have her dad be the one who gets CB, or move in sooner, it might be a tiny bit of hassle to put the bills in your name but surely sending your daughter to a school you like is more important than changing a few little things like council tax.0

Most Councils use experian to cross-check for consistency. If there is supposed to be a single householder that check for any other accounts held by another person at the same address, driving licences, electoral roll etc. Read a few of the customer compliance threads on the Benefits board.
If gets a pain when an ex will not move their old bank account or phone account or take their name off a now redundant joint account (or allow it to be closed) and you get called in but having a whole raft of accounts in his name would make it extremely difficult for you.If you've have not made a mistake, you've made nothing0 -

Unless i've missed something the OP isnt claiming anything from the council?0 -
ok, so am i correct in thinking this is what i have to do?
get ex to change his details (such as tax/n.i - he's self employed, his bank accounts, mobile phone registration etc..) to his old address, that his cousin is renting? can he stay in this address at his Dr/Dentist? He won't leave his Dr's practice.
change everything into my name, such as council tax, water, electricity, phone etc... also inform HMRC and DWP of my new address, plus my bank statements, mobile phone contract, or can bank and phone stay at my mum's?
now, the mortgage, it comes out of his account, it's his house, nothing to do with me. do i need to do anything about that? am i allowed to live in ex's mortaged property and have all bills in my name? bare in mind i won't be getting HB, just CB, CTC and WTC.
when i do all the above again in may, and ex does the same, is that ok? or does it look strange? it's so important that we get her into a local, decent school, but at the same time i don't want to do anything wrong.0 -
