Help with P11D

Hi all,

An ex-employer has filed a P11D for last year for a 'company car' I drove for 4 months.

However, the car was a hire car which I understand (possibly wrongly!) is not subject to company car tax.

My ex-employer is 'dodgy' to say the least - refused to give me an employment contract while I was there which was one of the many reasons I left. I am concerned that I am now subject to tax for a benefit-in-kind that was never 'official', for a car they do not own or lease.

Many thanks got any help/advice you can offer.

  • Not sure they are doing anything wrong - I don't think they have to own the car for it to be a "company car" for tax purposes. Sure lots of these are leased - the crucial thing is if your employer provided you with the car - which from your post they clearly did - then you will have a taxable benefit which they should report on the P11D form.

    If you don't need to fill in a tax return HMRC will usually send you a tax calculation showing the position for last year, if you do a tax return you need to declare the benefit.

    You may want to check the P11D shows the correct information i.e. date car first provided, given back to employer, list price, C02 rate etc.

    presumably you did not pay anything towards this car therefore you had a benefit on it and so it is quite correct for them to declare that benefit on a P11D
