I wonder if someone can assist?
I have been in receipt of CB ESA for over a year. I was placed in the group which is not required to seek work as I had been having regular chemotherapy. Although my treatment has ended, I do not feel able to seek work on the basis of confidence loss, energy decine etc and I am currently receiving assistance from my GP over issues related to the after effects of the treatment.
Just after Xmas, I will receive my occupational pension and so thankfully, this will easily cover the loss of the benefit.
Payments are due to be reviewed/ended in September.
My question is - can this benefit just end or is there a transitional period of work seeking support? I assume that if I left the ESA, then I would not be able to claim CB JSA as a new claim because of the time lapse since paying NI stamps when I was in employment before my illness. I do not wish to claim
Income assessed benefits and so advice about the continuance of the original benefit would be most appreciated.

If your are assessed as no longer meeting the requirements of ESA then the payments stop immediately.Lost my soulmate so life is empty.

There are two groups in the main phase of ESA. Neither of them are required to work or seek work.
One group is the Work Related Activity Group. claimants in this group ar)e required to undertake Work Focussed Activities if invited to do so, (confusingly, some people in this group never hear from a JobCentre advisor). Contributary ESA in this group is limited to 365 days, after this time income-related ESA can be paid if the claimant meets the means test.
The other group is the Support Group. People in this group are not required to take part in any Work Related Activites and it is not time-limited.
finally, if someone has been reassessed and judged to be 'fit for work' the ESA will stop immediately. It is up to the claimant to apply for JSA if they can meet the contributary and/or financial requirements.0 -

Its important that you realise that you must report a change of circumstances in your illness to the DWP immediately. Based purely on what you have said after a short period of time your energy levels should return enough to engage in some level of work, a lack of confidence is not a reason to claim ESA, this would mean that on the basis of your post alone you would not be entitled to ESA and therefore claiming fraudulently.
I don't mean to sound harsh and i understand you have probably been through a taxing time but you cannot use the benefit system to get you through to when you claim your pension in 8 months time."You've been reading SOS when it's just your clock reading 5:05 "0 -

With regard to the post from Sammyjammy, I must point out that the application process for ESA requires a much more in depth and professionally and medically evidenced and supported description of needs than can be gleaned from a brief post on this site. It is beyond anyone's scope to judge entitlement and to suggest fraudulent activity based upon what brief details are contained in my first post.

I think you will find that you still qualify for the Support group at the moment as you are still in receipt of cancer care and the after affects of Chemotherapy can last for months after the last treatment. I know as I have a friend who has been similarly hit by it all and she got into support group no problem. If you are on or will be on Income related ESA then the Occ pension will replace some or all of the ESA depending on how much it is, but it is still worth going ahead with it all as you will still get help with prescriptions and other stuff in the mean time. Hope the treatment goes well and that you feel better soon.0 -
You are in the Support Group and you expect to be reassessed in September.
So, you will be sent a new ESA50 to complete.
You will be assessed with or without a face to face WCA.
If you pass reassessment your ESA will continue to be paid, but if put in WRAG it will be limited to 365 days (or until next assessment whichever is sooner). Depending on what you were doing before this ESA claim, that could mean that you will either have 273 days remaining or 365 days remaining.
If you are put into SG again your payments continue until the next assessment.
To answer your JSA C eligibility I need to know:
When did your employment finish?
What date did you claim ESA from?0 -

I completed chemo late last year but there has/is radiotherapy too and medical issues relating to the 'collateral damage' of both treatments.
I finished my last working contract at the end of December 2011 and then claimed JSA in February and then moved to ESA in March when my illness was finally diagnosed. Up until very recently, I received DLA but I did not apply for this for the second year.
I will complete the appropriate form when the time comes to see if I continue to be eligible in September and on until my occupational pension eliminates entitlement just after Xmas.

First of all you need to know (because I forgot to say) that if you fail the assessment in September as long as you get sick notes from your GP you can continue on ESA at £71 week whilst on appeal.... which could take anything from 4 months to 1 year. But payments will be limited to 273 days.
However, the rules on payments on ESA appeal could be changing in September/October 2013 and you may not get paid straight away.
If you claimed JSA C after reassessment in 2013 they will use tax years
10/11 & 11/12
We already know you pass the requirements for the 1st year so if you were employed and earned at least £5,500 for the period April 6th 2012 - December 2012 then you will qualify for JSA C again for 6 months (your period of benefits from February will also help you to qualify if you earned less than £5,500.)
If you do not claim JSA in 2013, but instead claim JSA C in 2014 (after perhaps losing an ESA appeal) then as long as you earned £5,500 or more in the period I mentioned before then I am also sure you would qualify again for JSA C.0
