Parking Eye PCN

having looked through so many of the posts regarding PE PCN's I feel I should ignore the one I received last week....easier said than done!! First ever pcn and was about to pay until the search for the payment site led me here. My story is.....parked in a hotel car park controlled by PE (no such thing in my own town!), noticed all the signs, warning of fines, penalties and whatever. parked the car and made my way to the ticket machine. typing in my car reg and a guy comes up to me offering me his ticket which is still valid for 3 1/2 hours. wham bam thank you mam!! noticed his reg on ticket but thought will stick it on windscreen anyway. just so happens ran slightly over time as well. Came back to car after an average lunch and fine walk, drove off never having a second thought. one week later receive this pcn for £60 which will change to £100 if not paid by 24/5/13, yes this Thursday. :eek: Anybody with any advice. Only council ran car parks in my own town so should maybe have thought more of it when we saw all the signage and camera's this time....cheers

    Ignore is the OLD advice.

    Send PE a legal challenge not mentioning what happened nor even who was driving (written in the third person, all about PE and not about you!):

    And complain to the Hotel very quickly - they normally have the ability to cancel these fake PCNs if you ask assertively but politely, within a few days.

    Let us know if you get rejections from both. POPLA will be the next appeal stage (if in England/Wales?) and that's the one to get advice about wording well. Needs to be a strong legal challenge as you will see posted about on many PE threads here.

    Hi OP, firstly I love the user name as I too dislike ParkingEye, so my sentiments exactly.

    I have an ongoing issue or two with them. By all means deny the charge (without using "appeal") on account of it being a false and illegal penalty; but when the POPLA form comes, don't use the same argument by itself. State it, yes, because it is true that if they seek a figure beyond losses "for breach of contract" then that spells out "penalty", but add other things to it. By that I mean when ParkingEye send you the POPLA form with its reference number on it, leave a note here again seeking the best points to make so that POPLA reject ParkingEye's plea. But win, lose or draw in your case with POPLA, don't forget that their decision is not binding for you. Only the court can make you pay their stupid demand and that is not going to happen.

    The beauty of it is that you are rejecting PE's demand because it is illegal (in addition to certain breaches of BPA codes) so the question of whether alleged incident even occurred is not open for discussion - because you are not satisfied that PE's behaviour is lawful in dealing with such an incident. Once they convince you that their two fees according to date are a pre-estimate of losses (i.e. never), you can then move on to the shady issue of whether the alleged incident happened.
