Payment went into ex bank after I changed claim

Got a letter today saying there had been an overpayment of £256.01 from last year, I split from ex on 3rd April, informed tax credits straight away, I explained I would have no access to the account as he had stopped the card, they then put the above payment in on 8th, this is the first I have heard, he never mentioned it and was not likely too either, they said I can appeal to only pay half but I am so cross as I informed them soon as, yet again I am out of pocket, another thing in a long line of things since spilt, any advice?

I would say appeal and use the appeal to ensure you dont pay anything as it is there mess up. But be prepared for a fight and a lenghty process. The problem with joint claims is they are equally liable, they may say that the timescale was not suffcient to stop the payment especially as the dates include a weekend.

The tax credit office has 30 days to process a change, if after the 30 days the relevant change has not been done then there is an argument to be made.
