Northern Rail - Court Summons for non-designated car parking

Hi Folks,
I have received court summons from Northern Rail reg – not parked in a designated area to appear in Chester’s Magistrate Court on 16th May 2013
This happened on 3rd October 2012, when my wife regularly commutes from Hazel Grove to Manchester. She went to the car park after 10am and could not find any spaces and was pushed to car park in an area which was not causing any OBSTRUCTION (that day she was attending my kids school assembly and she came there around 10:15AM and there was no parking space). We have seen numerous time that there aren’t any parking spaces available after 10am and have seen people parking on the kerb “without obstructing” the way for other vehicles.
As soon as we received the first parking notices asking us to pay the fine of £50 pounds, we have responded explaining the situation and requested to reduce the fine. An email was also sent to Northern Rail explaining the reason. Then the second letter came through and the fine was increased to £100 pounds, which we ignored.
Now the Northern Rail have issued a court summon to appear in the court. They have also mentioned in the “Statement of Facts” as letter was received from us disputing the notice however no address was supplied. I would like to pay the fine through out of court settlement, but Northern Rail Summons info sheet says as below:
No – you must respond to the summons, either in writing or in person. The costs on the Summons represent a contribution to our costs, additionally the Court may impose a fine if you are convicted.
I have seen numerous threads on this and have seen people ended paying fine more. Is there any way I can do out of court settlement? Thanks
