Still safe to 'Ignore'?? 2nd Notice

Hi,

I have attached a copy of my 'Fine' from VCS Ltd, they have sent me a 2nd notice with the uprated fine amount. With even more scary threats if I don't comply!

To date can I still ignore all correspondence from these AND 'Debt Collection' agengies??

    We cannot tell you what to do, that would be taking away your freedom of choice, but if it was my notice I would be placing it carefully in a file to look at whenever needed.

    This Notice To Keeper is not compliant with the provisions in Schedule 4 of POFA 2012 with regard to holding the registered keeper responsible for an unpaid parking charge. There is a definite timescale that must be adhered to if they want to invoke keeper liability i.e. the NTK must be received between 28 & 56 days after the "offence". This NTK is over three weeks late. It also does not name the Creditor which is another detail necessary to be complaint. There are several other irregularities. They already have your details so personally I would write to them & without acknowledging who might have been the driver nearly 3 months ago challenge them that as RK you are not required to do anything as they have not complied with POFA 2012 & that they should either cancel this charge or provide a code so that you can take the case to the "independent" appeals body POPLA where you will present the evidence of non-compliance plus non-adherence to the BPA CoP & require VCS to produce their contract with the landowner that empowers them to collect parking charges and pursue to court if necessary.

    Thanks for your rplies guys! Well this screenshot is the 2nd notice. The 1st one was dated 20/02/2013 if that makes any difference?! I've read previously NOT to write and just ignore all including 'debt collection' agengies but this is why I have asked here, as I know alot of people have got away due to it not being a legal fine etc.. but wanted the most up to date info.

    OK, if no ticket was left on the car (a Notice To Driver) then the first letter that you received through the post 20/02/2013 was the real Notice To Keeper & VCS are being very sneaky by calling this letter the NTK as it is not within the meaning of POFA 2012 but is just another reminder. As you are outside the time to appeal to VCS & POPLA then your choices now are either to pay or continue ignoring.

    Do you mean that they have already sent a letter in the post in February (a 'real' Notice to Keeper) where they 'offered' an appeal and POPLA?

    Then do I take it this is the second supposed 'Notice to Keeper' with no POPLA offered and simply trying to fool you into appealing now. Don't. Too late.

    But next time, you should be aware that some of us here recommend appealing when you get the first NTK and where POPLA is an option. Too late for that now so you are officially in 'ignore mode' and can just play snap with each letter in the chain:

    Thanks guys much appreciated!!

    Basically the first letter was a NTK and chance to appeal I beleive which I didn't do... I was more surprised there were ANPR cameras there and had photo of my numberplate entering and leaving carpark!!

    £100 is stupid and I'm not paying that. Lets just hope I don't have some muscle turning up at my front door!! :/

    Nobody will turn up at your front door. They just send out these stupid letters hoping people will be frightened into paying up.

    Even if they did, they are just private citizens with no powers, and you can tell them to "get lost" in whatever way you wish.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    That doesn't happen!

    You are muddling bailiffs up with debt collectors (the latter are pen pushers in a call centre only). This old pepipoo thread explains it well:

    You will get the letters I already posted the link to, have fun just laughing at them now it's too late for POPLA (which would have been fun because you'd have won I suspect, with help from here, so don't discount it next time!).
