CCA request

If a CCA is requested and the creditor does not produce one, then what would this mean?

    Depends on the circumstances really? And if you think they may eventually be able to supply one?

    Are we taking theoretically here? If not, and you have sent one, what was their reply, if any?

    You could send them a reminder, setting out again the consequences of them not complying.

    You could see whether they are open to a F&F. If they can't provide the CCA info, and hence the debt is not enforceable in court, then they may be open to a better F&F deal that would otherwise be the case.

    It is theoretical really, I have a debt with 1st Credit, it was sold to them at the end of March by Blackhorse, who have added on £350 in charges and interest since I started with Payplan.

    (it was actually sold the same day I sent Blackhorse an F+F offer)

    I offered a 40% F+F to 1st Credit and they wanted 90% and they said they never take less than that.

    The loan is from 2006, and I wanted to see if I could improve my position in negotiating a F+F.

    The 40% was a starting figure that I did not really think would be accepted.

    Without the interest the debt would be £1531
    and with it is £1881.

    I am just trying to get a strategy in my mind, I still have nearly £30000 to pay off and I want to make the most of this money that has been offered to me to get my DFD nearer.

    They certainly will go lower than 90%, but obviously will try it on in initial stages of negotiation.
