Apex Credit Mgt Reply to my CCA Request - what do i do?

Dear xxxxx,
Further to your letter dated 15th April the contents have been noted.
Apex Credit Mgt are not the data holding branch and are therefore not obliged to supply the data you have requested, this information should be requested from our clients.
Please contact our client directly for a copy of your credit agreement with the statutory fee. Our clients address is ......
Now what do i do this sounds abit fishy..........i thought they have purchased the debt from Santander so why i they saying they are not obliged to send me this data. Or does the debt still remain with Santander??

Thank you for your letter.
I would remind you that if you are acting on behalf on your client, then you are obliged to pass on my request and fee under s78/79 to them.
If however you have received this account by assignment, then as per Jones v Link Financial Ltd [2012] EWHC 2402 (QB) you are obliged to supply the requested documents yourselves. If this requires that you contact the original creditor obtain these, then you are obliged to do so.
In either case, my request remains outstanding and the original time limit for compliance applies.

Many thanks Rizla King. They even sent back my postal order. This is costing me money sending recording delivery to these idiots.0 -
why not just send it to the lender? Because the more you mess around, once they do produce the higher the lenders recovery charges mount up to you.Don't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
