eurocarpark/roxburghe help pls

hi,

i have read many posts here saying to ignore the letters regarding a pcn i recieved. the trouble is the car is registered in my uncles name so i wrote to eurocentral via email to advise them i was driver not my uncle and to deal with me direct.

so my question is...now they know i was driver should i pay up or still ignore..the fine is now up at £138. i am worried about this affecting my credit rating but i feel a £90 fine for shopping and eating in morrisons, parking in an already free carpark for customers is greedy and crazy.

i am worried that they will start to call my uncle, who will hit the roof if he thinks that debt collectors have anything to do with him.

    Why do you think that you should pay up?
    It is not a FINE.
    Your credit raiting will not be affected.
    You owe the PPC nothing.
    Please read around this forum to see how these PPCs work.
    A strongly worded complaint to the store manager is in line ithink!

    Please don't confuse debt collectors with real bailiffs. The former are just private citizens with no special powers. They won't come to the house, they cannot enter premises, they cannot seize goods and they cannot blacken your credit record.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    coz i went over the time stated and i was driving i guess therefor technically i was in the wrong...i just have an issue with the over zealous amount, jeez even the city council is not that expensive.

    You were not "in the wrong",
    You were using the store facilities, you were spending money in the store.
    They are in the wrong for thinking they can charge a stores genuine customers.
    Complain to the store manager, tell him that if he does not get this invoice cancelled then you will take your custom elswhere , tell him you will also inform your family and friends of the way they treat their customers.
    Do not let him fob you off that he has no controll over the PPC ,because he does. The store ARE responsible for the actions of their agents.

    The government's own advice is that
    Charges for breaking a parking contract must be reasonable and a genuine preestimate of loss. This means charges must compensate the landholder only for the loss they are likely to suffer because the parking contract has been broken. For example, to cover the unpaid charges and the administrative costs associated with issuing the ticket to recover the charges. Charges may not be set at higher levels than necessary to recover business losses and the intention should not be to penalise the driver.
    Trying to scam you out of £138 is not "reasonable and a genuine preestimate of loss". It was a free car park the loss is £0.

    For goodness sake, please just complain to Morrisons. Why do people worry about the threats of the 'monkey' rather than complaining to the organ grinder. Stop giving the car park scammer so much respect that you are worrying about it. And they cannot write to your uncle now you have appealed as the driver (which was the right thing to do to hook the stupid scam away from your Uncle if he'd actually fall for it).

    A PPC has no real 'authority' and it's not a real fine but Morrisons are responsible for this threat hanging over your head - so tell them it's not acceptable!

    All you have to do is go in with your receipt and complain to the Store Manager, then email or write to the Head Office with a copy of the receipt and a MAJOR complaint if the store fails you. Thionk about it, a Supermarket can't fine a customer for shopping and then using a cafe!
