parking eye problems

Hi all, got a small problem with parking eye.
got the standard " you have overstayed in a free car park"letter this morning. however as my girlfriend is blue badged disabled & in a wheel chair it took us longer to shop

my question is is it worth appealing on those grounds, reall cant afford £100

Firstly, you don't need to pay it anyway, its an unenforceable invoice.

Secondly you could put them on the back foot by pointing out to them that if they continue to pursue this ticket then they would be in breach of the Equality Act 2010 by not making a suitable adjustment for your girlfriend.

Was her blue badge on display at the time? If so, they shouldn't even have issued a ticket. However if it wasn't, you ought to draw it to their attention now, and mention that they would be in breach of the Equality Act 2010 if they continue to pursue this.

They really ought to drop it at that point, but let us know either way.

thanks but you cant see the blue badge anyway, they sent the twin photo letter, just saying i stayed 3hours , 19 minutes

It doesn't matter, as long as you inform them now that your girlfriend is disabled (send a photocopy of the badge) and that they need to make a reasonable adjustment for her needs as per the Equality Act 2010 (in other words allow additional time) then they ought not to pursue this ticket any further.
