9 Hour Flight Delay

Mine and another family experienced a 9 hour delay last October. We arrived at Gatwick to be told the flight to Faro had been delayed and due to it being a larger plane two smaller ones were being sent for. Unfortunately, we were put on the second flight. Our original flight was at 6.10am, the first replacement flight left at 10.45am but our flight boarded at 3.10pm, then was held on the tarmac for another hour and left at 4.10pm. We have written to Monarch but they have rejected our claim due to 'exceptional circumstances' due to a technical fault. We can go the next step and appeal to the CAA, but does anyone have any other suggestions?. Could we call Monarch's bluff and say we are appealing and see what they say? Thanks
