Downstairs landlord appears to have turned the water off...

  • I'm confused by this thread where is the stopcock for your flat????

    Do you know?

Can't believe that the stopcock for your flat is in another one???

I have a stopcock in my flat for my water, however as is often the case with a pair of flats, there is another one downstairs which controls the water flow for both flats. I can turn my water off individually from theirs but if they turn theirs off mine goes off too. This is what is causing the problem.

Yes. Did you read the link to the Act?

YOUR landlord has a statutory duty to provide a property fit for human habitation (as defined by the Act) in return for the rent.

He also has a contractual duty, which includes providing alternative accomodation, and compensation for losses.

Seperately, as the owner/leaseholder of the flat, he has a legal right to the water supply, which he can enforce against the building's freeholder and/or other flat/leaseholders.

So it is therefore his duty to you to enforce his right on the guy downstairs. And to help you.

Now, I'm not saying you should not attempt also to resolve this directly with downstairs if you can (though you seem to be struggling), nor am I saying you must demand compensation etc from your (as you rightly say innocent) landlord.

But you should at least report this fully, and formally, as well as make sure your LL understands
    a) this problem falls within his responsibility
    b) it has at least the possibility of costing him £ if it is not resolved.

    Write.

    Right?

If the issue is still not resolved by the time I get home from work tomorrow I will try this approach. Thanks.

  • I seriously think GM's approach is exactly the right one.

Btw I don't understand why being at work prevents you from phoning in the day??? Surely you must get some kind of a break for lunch or something?

I really think you need to take GM's approach and in addition speak to Environmental Health who will pursue it on your behalf while you are busy working. (They are quite helpful in my experience so make it your priority tomorrow morning to phone them.)

Good luck tomorrow and let's hope it brings a positive outcome.

I don't know why people think I can't phone during the day? What I said was "l can't do anything but phone during the day" meaning I can phone during the day but cannot get to the office in person which would probably be more constructive.

  • My mistake I did wonder it was just the way it was phrased.

Anyway lets hope you get your water back today.

Thanks. You weren't the only one to misunderstand. I should be getting a phone call any minute now. If I don't I'll be back in touch with them again.

I think if I did not have water I would be doing more than phoning and if that meant visiting various people I would do that whatever work thought. I would class this as an emergency.

    I have water!!!!!:j:j:j

Since getting home from work and discovering that I have water again I have cleaned the bath and bathroom sink and then dirtied the bath again by getting in it. Never thought I would appreciate as much as I did tonight. The pile of dirty dishes in the kitchen can wait until tomorrow, as can everything else. I'm far too clean to get dirty again by cleaning other things.

Thank you for keeping us up-to-date :(
  • Glad we found out eventually!!! I've been worried about this all the time I was away on my long weekend ;)
