departmen for work and pension loan from 20 years ago...

19 years agowe had a loan from DWP and we are absolutely sure we paid it off. we are very good in keeping paperwork in general but every now and then we get rid off some very old staff. unfortunately few years back we destroyed all paperwork related to that loan and the property we lived in 12 years ago. suddenly last week, we received letter
(first time in 19 years)
that we own the full amount, just under 1K. after a phone call to relevant dept. I have been told that I have to pay if I can not prove that we paid it off. how on earth someone have to keep receipts for 20 years and if we did not paid it off, how we never got single letter about it.
do we have to pay this back again, any suggestions please

  • unless you can prove that you did then basically yes,they can ,you may not be able to take you to couty for it but they can and will deduct from the next benefit you get,even if they have to wait till you get state pension
  • There is no statute of limitation here - if you can't prove it then you may be liable.

    Not true. Loans/debt from DWP can be statute barred just like any other debt.

    All that actually means in law though is they cannot take you to court for it. They can still deduct from future benefit payments to recover it.
