Delay in switching means now liable for fee. Advice?

We recently decided to switch from our Skipton mortgage at the end of our deal to a five year fixed rate with HSBC. We had a 90 day period to get out of Skipton without any penalty or fee. Great...
All the paperwork went to HSBC early in December. Last date for transfer without fee was the 29th. They missed it. In fact they still haven't transferred the money.
When asking both parties about the fee we are now liable for (£125) they both say to take it up with the other one. I believe the solicitors for HSBC are at fault, as they are the cause of the delay.
Any advice for getting out of this?

If you had taken action at the end of the term. Then time would not have been an issue. Instead waited two months before applying. Then like many people made no allowance for Christmas.
Hard to see either party admitting liability for the fee that you've had to pay.0 -
Thanks for reply! I can see you would think that and yes it would be short sighted to leave it so late but we started the process in October!0

Paperwork from their solicitors to instruct. Approx the 2nd. They made contact with Skipton on 6th. There may still need to be some investigating done as to why nothing has happened yet.0
