Should I contact Solicitor about will money?

Hi...my late uncle died 2 1/2 years ago...my brother and the Solicitor are executors...my brother doent talk to me!! I contacted the Solicitor a while back and he kindly sent me a copy of the will...Myself and my 2 children have already received legacies...we also are due 1/4 each of the "Residue" ..which is quite a bit....I understand that the Solic. is making sure no oustanding debts/ bills need to be paid....it's almost 7 weeks now...no sign of the money...is this right....am i being impatient?....I dont like to ring the Solicitor!!! do you think I should? thanks

    Do you know when the last of the assets was collected/converted to cash.

    2.5 years is more than long enough to have done debt research except for the final things like utilities if a house has just sold.

    Are the kids under 18? there money will need to be in trust.

    I would probably ring to ask the status and an get an interim set of accounts.

    Thanks...Yes... the house was sold some time ago...legacies where sent out from this sale.....kids over 18....I know I'm in the will...does this give me the right to ask how the process is getting on?

    The primary role of the executors is to act in the best interests of the benifitiaries.

    Some solicitors can be slow unless prompted.

    Has a beneficiary you have no rights whatsoever other than to receive what you are entitled to. The solicitor did you a favour by sending a copy of the will which they didnt have to do. A letter to them would be a good step but they do not have to reply and if they did this would be more money from the 'residue'

    Thanks...I emailed the Solicitor...he was fine..said that utilities had all been sorted...except British gas..who had said refund was in post. ( last november!!)..twice...Solicitor called them a 3rd time last week...in post again...will review thing in 2 weeks.....why cant he send out money...then any more when refund eventually comes in?

    He would charge you numerous times for the letters cheques etc. Its not as straight forward as to just send interim payments. Is there any rush for the money?

    No rush really...just my 2 20 yr olds...keen to get sorted!!..Also..there are some concerns re my brother who is joint executor...stories about possible attemps to get Uncle to sign cheques before he died..I just want to know nothing has been going on....just want it finished.

    One would hope that the effect of "check and balance" by the solicitor as co-executor would have picked up on numerous or large transactions on the deceased's account just prior to his death.... You may not be able to find out what activity there had been in Uncle's accounts prior to his death even if you were to see the Estate Accounts. Why not just ask the solicitor?

    It sounds as though the solicitor is being appropriately cautious about not distributing the residue until the final financial matters have been sorted, frustrating though it is from your perspective understandably.

    Sometimes it is better to accept what is coming your way as a pleasant bonus, and move on from any possible wrongdoings, especially if there is nothing you can do about it. ;)
