CCJ on Equifax credit report only, still unsatisfied although paid

Hi,

I've been checking my credit report on CreditExpert for a couple of years, and slowly getting my credit rating back to a nice high level - this is just fine and looks great. Today I decided to check Equifax as I got denied credit for a phone contract and couldn't understand why.

It seems that Equifax have a CCJ for £2680 from March 2008, and recorded it as unsatisfied. I double checked with Registry Trust online, and they also have it recorded as unsatisfied.

Now, the only thing I can think it would be (the amount matches) is from an old Pipex bill that I spent years disputing. I only paid because I had letters from the bailiffs, and living in a shared house it had the potential to go bad.

So, I paid it all off ~ 3 years ago, and a week later after paying the last installment I got a letter and full refund from Tiscali (Pipex new owners) for £2680.

I then thought nothing of it, after all they had refunded me, so I figured that they had finally realized it wasn't actually my fault (£2000+ on calls to a silent number?!)

I rang TalkTalk today (Tiscali new owners) and they told me they can't access my account because it was closed 2 years ago...

I'm now in a bit of a pickle, as my credit rating is basically ruined by that CCJ on Equifax, and I'm not really sure who to contact to get this resolved.

As far as I'm concerned, that CCJ should never have been put against me, as it was a dispute and I got all the money back! I'm also confused how its still unsatisfied and only shows on Equifax?

It especially sucks at the moment, as I'm looking to move house and get a car on finance, but looking at this I'm up a nasty creek with no form of propulsion!

Any ideas would be most welcome!

Regards,
Ben

If there were bailiffs involved then that debt certainly went to court, and so there would be a CCJ.

Have you still got the letter that came with the refund?
If you contact the court that issued the CCJ then they can send you a copy of the original judgement. You could then look in to a set aside claim, on the basis that you didn't owe the money at the time (as demonstrated by the letter with a refund).

  • Thanks Tixy,

How do I find out which court it was? Would it be Northampton CCBC? I never recieved a letter, as the date the CCJ was issued (3/3/08) I was living 100 miles away and to be honest had not even considered the Pipex account to be still open!

The problem is that I don't have any of the letters anymore, which is why I've been trying to find someone at TalkTalk who can help me - I threw it all away when I got the refund, the matter was closed as far as I was concerned.

Anyway, I'll try the court and see what they say about it - although I would have thought that once it was all paid they would have changed it to satisfied, rather than leave it open.

Does your credit report not show what court it was? If not then the registery trust certainly should. Its likely it was Northampton.

If you paid the creditor, or a bailiff appointed by them the court wouldn't necessarily know it had been satisfied. You often have to show the court the proof/receipt that it has been paid.
You then ask the court for a certificate of satisfaction, they then update the registry trust to show its been satisfied, and in turn the credit reference agencies are updated.

But the money was refunded? So surely grounds to get the CCJ set aside? Rather than recorded as settled?
You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

Yep I would think quite possibly, as I said in my first post. The second post was in response to why it wouldn't be currently showed as settled as queried in post #3.
