Wondered if anybody could help me please ? The house next to me is council owned. They have put a new roof on next door and damaged mine in the process. The Housing Ombudsman say because I am not tenant they can't help me. I have exhausted Adactus Housing's in house procedure which is sole destoying. The work has been rectified but has left me out of pocket to the tune of £250 due to getting a surveyor out to to point out the damage they had caused.

Many Thanks

Have you sent them a recorded letter asking them to pay damage costs? Have they admitted any liability? Take them to the small claims court? Write to your local mp?

Court - small claims court action for £250 - suspect they won't even contest it and chances are that on issue of proceedings they'll cough up - can be done online.

The HA are answerable to the civil courts in the same way as any other citizen or company-that's your remedy (via the small claims process).

Did you employ the surveyor before contacting the council / Housing Association?. Did the landlord dispute the damage making it neccessary for you to employ the surveyor?.

Thank you all for your help. I am starting the process with the Small claims court. I employed the surveyor after I had pointed out to the Housing Association 3 times the damage they had done ( they had failed to put a tile back every other row from top to bottom ) luckily i took pictures before with the time and date on. I will keep you all posted. Many Thanks once again.
