I have been in debt for some years now. I eventually gave up fighting what was a lost cause trying to pay them all off at the rates they required. I went to the local CAB office and they worked out a plan for me.They did all the working out and writing to the companies for me. All has been fine until recently. I was paying off my littlewoods catalogue at £5 per month, then i had a letter saying the debt was being taken over by Moorcroft debt recovery. Ok so i spoke to a very rude, arrogant man on the phone,told him what i had been paying and that i could only possibly afford to put it up to £10 a month max. I then had another letter saying i was to pay £80 a month. Well i do work but i have a lot more important debts to pay off aswell. I have made 2 payments of £10 to them so far and i will pay another £10 next week. I have received another letter today though saying i have defaulted my agreement to pay £80 per month and i now must pay the other £60 arrears. I have never said to anyone that i agreed to the £80 per month. They also say that if money is not received we may instruct our solicitors to commence legal proceedings. Now i have always been under the impression that as long as you made a regular contribution and effort to pay some money back that it wouldn't go to court,is this true? Also what happens with these legal proceedings? I have finally got a good budget going and all my debtors off my back, now i'm starting to worry again, can someone put my mind at rest? Is this just another standard letter? Will they accept my £10 a month? The total amount i owe for this debt is just over £1100

You must go back to the CAB, they will be able to tell you.

Yes go back to CAB. They might have to go through the whole process again I'm afraid. Renegotiating like this is annoying but you just have to go with the flow.
As for court proceedings, they are very unlikely to go down this route once CAB are involved. I'd keep paying the £10 because it shows you are willing. The only thing that you must not do is ignore them and stop paying.

Thanks for your replies. The only problem i have now is getting to the CAB. Work makes it very hard for me to get there whilst they are open. Thats why i thought i'd ask on here.Share a smile today0

Ask the CAB to challenge the debt. As it is with a catalogue it is unlikely that you have signed a contract with Littlewoods. If you haven't the debt exists but is unenforceable0

I havent posted on here much and i can see why new people feel intimidated when folk like you patronise everything.

the reason they are getting shirty is because they KNOW they are not a priority debt and are trying to panic you into paying more.
Perhaps you could take a sicky to go to the cab as the stress will be affecting your health?
good luck.Was the man you spoke to from moorcroft central or your local collector?.Mine is always helpful,polite and businesslike and moorcroft keep a very close check on him,askng for my card to be posted to them to check it.If you find the local collector rude then phone them to complain.Just because you owe ££ does not mean they have to be rude.

Thanks for your reply crutches. The guy i spoke to was from Moorcroft central, i dont have a collector. I hate speaking to any of the businesses i'm in debt to on the phone,i feel intimidated by them, especially when they speak to me like i was just on the bottom of their shoe. I never remember to ask for their name and get all tongue tied.Share a smile today0

always good to write - that why you have a record of what is said from them. if they phone you have a right to request everything is done in writing and too stop phoning you at home/work. if they persist they risk losing their license. Also speaking from experience post often works best - reason being telephone collectors are heavily targeted to get in as much money as possible and are employed to use their skills to force as much money as possible out of you, Whereas with post it is often done by admin staff and they are more likely to accept.
