What should i do when a seller sends me a like to download software

I bought a diagnostic tool and the cd that came with it had nothing on, so i contacted the seller to tell them there was nothing on the cd and would they be able to send me another cd. I then get a reply saying If the CD is blank,please install the software from the below link. So as i don't have internet access in my home i tried to download the software using my mobile phone but i keep getting a message that my phone isn't compatible. So i sent the seller a message to say i don't have internet access in my home so i tried to download the software on my mobile and i keep getting a message that my phone isn't compatible. I then get a reply saying Sorry,there hasn't extra CD in our warehouse and it is also easily broken if only ship the CD to u
.You must connect the product into the computer ,then you can use it. You won't use it on the phone.Hope u know it!

Please try to install the follow software ( Link to software) into your computer,then you can directly insert this product into your car and computer,Thanks!

So what do i do now as without the software the item is know good and there listing is showing they have more than 10 available. If i send the item back where do i send it to as there location is in china but the item was shipped from portsmouth.

    You could probably claim an SNAD item. The seller has sent you a blank CD to get round digital delivery but you could plausibly claim not to have received what you purchased.

    I have opened a ebay dispute and this is what the seller have said.
    Sorry for any inconvenience to u! Firstly ,the prodcut only can fit with computer.It won't use on the phone.Hope u know it at first! Secondly. we would explain it to u ,that each product only has one CD with it.The software in the CD is same with the link .I think that the link is easily to help u solve the problem soon. Thirdly, if you can sure that the product can't working,then we would offer a correct returning address to u ,then you can return it backt o us.We would refund to u .What do u think for it? Because we were afraid that the other cd has same problem. Thanks for your support and understanding! What do u think for it? Any question,please do not hesitate to contact with us! Have a nice days!     So what would you do now as i know it's not the sellers fault i don't have internet at home but if i knew he would be sending links to download the software i wouldn't have bought the item.

    That's still not-as-described - if the seller didn't say that they would send a link to a download then that is the same as saying you are buying a CD and sending you a cassette tape instead.

    You could message them back and say that unfortunately you have been sent a blank CD.

  • I tried telling them that the cd was blank before opening the dispute and they kept giving me the link to download the software. So i have checked the sellers feedback and there is a few that have said the cd was blank and the seller replied saying they could have given them a link to download. So if i send the item back does it have to be sent to the sellers registered address on ebay as the seller said they would give me the correct returning address.
