EUjet "offer" - can they refuse?

Please help!

I got this email from EUjet stating that any remaining seats would go on sale at midnight for “only 1p each way including taxes and charges”. I managed to book my flights, but was charged 1p plus taxes and charges (about £15 each way). Previous emails, which I took little notice of, are worded differently and don't say "including taxes and charges" and the relevant page on the website says "plus taxes and charges" (which I noticed afterwards!).

My question is this: I booked in good faith, based on the info in their email (see below) - Can EUjet refuse to refund the extra charges, or are they legally obliged to honour their own mistake?

    As with a lot of the queries on MSE - you have to be prepared for the worst.

    If you are going to actually use the flights and can affort to pay the 1p plus tax then it is worth booking these and if you get them for 1p inclusive you are laughing but if not then it is still a cheap flight.

    There may not be many or any flights left in which case the cost of the taxes for the remaining ones may not be that much and the company may have budgeted for this but as I said - be brepared for them to refuse to honour the deal and if they do then it is a bonus IMHO.

    If only I lived in Kent...

    Think you have shown the wrong ad.It is quite clear that taxes etc are included. on it.

    If you have retained the actual email that stated 1p including charges,then that is
    a contract and they should honour it.The difficulty is that when you paid for it,the
    price would have included the charges,and EUJet could probably argue that you had
    accepted that price as the contracted one.

    Have you tried talking to them,to see what they say?You could argue that you were so happy at the time of ordering,that you did not notice the price or something along those lines.

    ????? It's the correct ad and it says 1p including taxes.

    Addy - Thanks for reading it carefully! I have written to EUjet asking for the fees to be refunded - I'll let you know if/when I get a response...

    Does anyone know the actual legal point of view on this?

    Sorry folks-I misread the statement.On the previous line it says plus taxes,and then
    when it continued with 1p including the charges,I read it that the charges were extra.

    Had you paid 1p per person,then the contract would have beenn fulfilled and probably nothing that EUJet could do.As it is,by paying the amount plus charges,they may well feel that as that is the contract you paid for,then that is the contract they have given you.

    Whether the company honours the 1p contract may depend on how many people
    complain or if they think they can get a bucketload of free publicitry from it-either by paying or not paying you.

    If they refuse to pay you could take them to court-which could take ages and be
    more costly than the amount they owe you.The Small Claims Court might advise you,
    but any legal advice [eg solicitors]would probably swallow your refund,even if you did win.

    Perhaps one of our travel agents would give you their view.

    It doesn't say what you think it does.

    It doesn't say that ALL tickets will go down to 1p including taxes. It says that there is an allocation of tickets, which will go at prices which will eventually fall to 1p including taxes IF THERE ARE ANY LEFT.

    So, when you went along and bought for 1p + taxes, they had presumably run out of the discounted allocation, and you bought some completely different seats at a different price.

    I don't think you've got ANY case to get the taxes and charges refunded - you didn't read the wording correctly when you agreed to buy the tickets. The advert got you to go to the site - it wasn't a guarantee YOU could buy seats at that price.

    No... it doesn't say what you think it does...

    The offer was for all seats to all destinations on Tues, Weds & Thurs during certain dates. The flights I booked were during those dates (or they wouldn't have been reduced to 1p). The question is whether it should include or exclude the taxes and charges.

    Ant expert advice please?

    The add definately says INCLUDING . I suppose it depends whether your seats were one of the 51000 allocated to the promotion. They probably have a lot more seats outwith the promotion. They are filling 30 000+ seats a month and rising
