Now.
I had a current account with natwest, with a measly £80 over draft.
I changed accounts, and this £80 never got paid, they added charges and charges on, and i currently have a default for £300+
Today, i recieve a letter stating that the account had some charges incorrectly applied to it, and they will refund me £76 + £16.83 interest.
This account is closed now, so they cant pay the money back into it, but my point is, do you think i can now get them to remove the default?
Basically these charges would pay back the £80 over draft originally owed, then i would have never had the excessive £220++ charges they have applied!

I got the same letter, 2 accounts both continuouslly overdrawn, however with this I got £256 + 11.50 and £76 + £11 back around 2 weeks ago now.. Was wonders!

But the account wasnt in default for the £92.83 they are refunding. If the default was originally shown as £300 as you say, then it is still a default for £208.17. They were right to default you for the £80 overdraft you never repaid, all they seem to be doing is reducing some of the charges levied.
I can't see why you believe the default is their fault ~ it isn't. It's just a coincidence that the amount you state (£76 & interest) is similar to the amount you owed them before any charges were applied.LBM July 2006. Debt free 01 Sept 12 .. :T

The FOS would require them to put you in the position you would have been in had the charges not been made.
If this would have left a nil balance and the other charges were applied afterwards (i.e. charges on charges) you are in a position to complain.
If not, you are in a position to have to pay.
They will also set the balance off by the charges, you will not get a cheque.BSC No 248
