Hi

as per the below i was advised to ignore and forget about the parking ticket -HOWEVER i have now received a letter from ROXBURGHE debt collectors who state the debt has increased to £160.00!! im just looking for advice what to do?

Should i still be ignoring this it has got me really worried?

Thanks!

Hello,

I have received a parking ticket today from PCN NW LTD for failing to pay and display this is £100 - £50 if paid within 14 days! however i did purchase a ticket which i still have but it did not have a sticky side so i just placed it on the dashboard and its blown over onto the other side you can still see there was a ticket just not the right way up! I logged onto paymypcn and there are pictures of my vehicle including one of the blown over ticket am i still right to dispute this? and is this firm classed as a private collector?

Any help will be appreciated :)

xxx

Thought i may add if it helps it was a college cark park pay and display

  • I take it this is a private company and not the initials of a local authority?
It it is public land and issued by a body acting for the council, appeal it by photocopying your ticket. You'll be let off for sure.

If it is for private land, ignore it and forget it. It is unenforceable.

Yeh it seems to be a private company, does it make things worse to appeal it rather than ignore? Thanks

It sends a message to them that you are taking them seriously and may earn even more attention than if you simply ignore them.

Like all the other posters on this board, you have a fake PCN. For a quiet life (unless you want to do the appeals thing to cost the scammers money as they are BPA members and would have to fund the appeal), just ignore it.

The whole scam of fake PCNs relies firstly on people's ignorance of the fact that a random private company can't fine anyone, and secondly on their natural fear of parking tickets and the escalating costs/bailiff scenario. So PPCs copy the look of a real parking ticket and - hey presto! - the cash rolls in from victims who know no better.

This is not a penalty at all. It's rubbish.

Tick off the threatening letters here.

Watchdog clip with expert Solicitor's opinion here.

    Barrister's opinion here.

So to summarise, when dealing with "tickets" from private parking companies (PPCs), issued for any reason, our advice is to ignore them as long as the registered keeper is you or a relative. The letters to ignore are easy when they arrive at the address of someone who knows it's all hogwash and not a real parking ticket at all.

Thanks for the replies, i'm still going to appeal as i'm still living at home and if it escalates i don't want to worry any one and let them think i just left it, however if my appeal isn't accepted then i will just simply ignore as i have advised them i'm not paying.

    Thanks again :)

That's fine as long as you take the appeal past the TWO stages, the second one being POPLA. That way, the PPC has to pay £32 for the appeal and you'll have taken the reasonable steps open to you.

Then you can ignore if POPLA do not find in your favour (it's not binding on you).

'Escalates' would only potentially mean a very rare Small Claim which you would win with the right defence. You will NEVER pay this fake PCN.

Do people at home open post addressed to you then ? Assuming you're the registered keeper then just ignore them and do what ever you like with the letters they send you. Of course this advice might be different if your Mum has x-ray eyes that are able to read letters still in their envelopes !

The present Mrs bargepole does exactly that!

I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

No they don't open the post lol but i think im still going to atleast appeal if they don't accept then i will ignore knowing i have advised them. Im just sceptical that you cannot just simply ignore the whole thing and the last thing i would want is any debts registered against me or bailiffs turning up and i would still be parking on college premises so they will see the vehicle each time they go round. Sorry just getting me a bit worked up.

Honestly, they can't register a debt against you just like that - you're confusing this with buying something on credit. You haven't entered into a credit agreement so don't have a debt. They also can't send round bailiffs.

Feel free to appeal but just expect even more junk mail.
