Hello,
I'm not sure where to turn with this one. Sorry it's a bit long!
I opened a bank account with Nationwide back in 2007 and in 2008, I finally got around to setting up my standing orders etc ready for my pay to go in. Turns out I didn't get the form to my payroll in time, so my pay didn't go into the Nationwide account but into my other account instead.
Anyway, I had 4 or 5 standing orders which were returned unpaid. For each of these I received a lovely charge of £25, or thereabouts.
I called Nationwide at the time and explained the situation, but they were unsympathetic and told me that the charges would need to be paid. I wrote letters back and forth for months until the account eventually defaulted in Feb 09.
I buried my head in the sand hoping it would go away, but of course that doesn't really solve anything. I've had lots of letters from collection agents and now I have another one from another company - Roxburghe. The debt has now spiralled to £392!
It just angers me that I never actually used the account and they still want to charge me such a ludicrous amount. 100% of the debt is unfair bank charges!
I would be very grateful for another point of view on this.
Am I likely to be forced to pay this debt?

Sadly yes. The £250 anyway.
You were responsible for setting up the standing orders before you made sure you wages would be in. That is not the problem of the bank, it is between you and payroll.
So the £250 is legitimate. Personally I would try to pay these off with Nationwide. And ask them to call Roxburgh off.
(Charges on an overdraft are very hard to prove as unfair and I wouldn't waste time on that).
You can call Nationwide for this, but do not pick the phone up to the DCA unless you are recording your calls.BSC No 248
