conned,feeling down,very sick

This is the letter ive wrote to the company i got the car off, ive been told it was a danger and should have never been sold!

its gone in for a MOT but andy who owns the garage says its gonna cost a lot and would be worth cutting my losses!

ive gone though tradeing standards and was told to put a letter in, now next friday it has been 14 days, so do i write to them? we leave in a remote place and i need a car every day for work, its a 90 mile round trip. my wife has the nissan for the kids, and the farm were her horses are kept.

i feel totally conned and to make matters worse it was my own brother who sold me it! he no longer works there...the money ive spent to keep it going is crazy.

any thoughts on what to do next?

I bought a Nissan X-TrailSport, 03 registration, from ‘Norwoods Trade Warehouse’ on the 16thApril 2011. I took out a finance agreement to buy the vehicle which wasprovided by yourselves, Close Motor Finance Ltd. The total price for thevehicle, including interest, is £5,275.72. I am still making these paymentswhich are due to end in April 2014, with a current outstanding balance of£2085.47.



I bought this vehicle as afamily car, at the time we had a toddler and my wife was expecting anotherbaby.



Since buying the NissanX-Trail I have experienced the following problems.


After completing the paperwork I drove the Nissan X trail home and discovered there was a problem withthe vehicle pulling to the left. I pulled over and rang Norwoods TradeWarehouse and was told to take it to a local garage to get the tracking checkedon it. I did this on the way home and it temporarily fixed the problem.


On the 29th October 2011 Itook the Nissan to AMR Autos for a full service. Andrew Reed, the proprietor,from AMR Autos rang me about the vehicle and asked me to come to the garage tosee what he had found.


Andrew showed me thefaults/dangers he found on the vehicle:


    [*]brake parts welded together
    [*]brake parts damaged
    [*]oil filter housing cracked
    [*]problem with the rear anti-roll bar


    He told me that what hefound was very dangerous, and that the vehicle should not be on the road.


    I have kept the parts thatcame off the vehicle.


    The bill for these repairswas £782.57. The problem with the oil leak was not addressed as I did not haveenough money to get this done on top of what I had already paid for.


    After being told about theproblems that had been found on the vehicle during its service I rang NorwoodsTrade Warehouse and explained what had been found. I was informed that thevehicle was ‘sold as seen’. I then rang yourselves, Close Motor Finance Ltd andwas informed that there was nothing that could be done about it as I had owedthe vehicle for over six months.


    On the 3rdApril 2012 the vehicle was taken back into AMR Autos to address the issue withthe excessive pulling to the left. It had also developed an intermittentproblem where the revs would cut out when the vehicle was being driven. As therevs stopped working I would have to pull off the road, switch the engine off,wait a few minutes and then turn the engine back on and could drive the vehicleagain. This would happen at least once every journey. Andrew Reed looked at thetracking on the vehicle but was unable to fix the problem with it pulling tothe left. He discovered that there was a loose wire on the throttle which hetightened and informed me that if this did not solve the rev problem I would belooking to replace the throttle which would be expensive. The bill for theserepairs came to £108.00.


    On the 24thApril 2012 I returned the vehicle to AMR Autos as the problem with the revs hadworsened. The engine was ticking over but there were no revs to drive thevehicle forwards. The vehicle was in the garage until the 18th May2012 when I was advised by Andrew Reed to take the vehicle to the main Nissandealer. Andrew was sure that the fault was caused by a faulty throttle pedalbut as it was going to be expensive to replace and he couldn’t guarantee thatit would fix the problem it would be better to take to a Nissan expert whowould be able to runs tests to make sure that the throttle pedal was theproblem..


    The vehicle was towed to BristolStreet Motor Nation to get the repair done. The vehicle was repaired and Icollected it on the 1st June 2012. The bill for these repairs came to £695.51.



    While the vehicle was inBristol Street Motor Nation they completed a full health check and found thatthere were more problems that would need addressing:



      [*]oil leak
      [*]near side and off side front suspension
      [*]rear brake pipes corroded
      [*]key fob not working
      [*]vehicle pulling excessively to the left



      From when the vehicle wentinto AMR Autos on the 24th May until I collected it on 1stJune I was left without a family car. At the time we were living in a veryrural area that did not have a bus service and I was working in Durham, over an hoursdrive from home. My wife was left without a vehicle to take our son to nursery andhad to borrow a vehicle from a family member.



      On Saturday 11thAugust 2012, my wife was driving the vehicle with our 4 year old son and 10month old daughter. As she was driving along the A174 the vehicle startedshaking as she reached 60mph, as she slowed the vehicle, concerned about theshaking, she noticed smoked coming from the front passenger side. She had toput on the hazard lights and pull off the dual carriage way onto a grass verge.When she got out of the vehicle she saw that there was a lot of smoke comingfrom inside the front passenger wheel. She removed the children from thevehicle and had to ring to find someone who was able to collect her and thechildren and return them home. On Sunday 12th August I arranged forthe vehicle to be towed back to AMR Autos. After investigation of the vehicleit was found that the brake calliper needed replacing. The bill for theserepairs came to £220.16.

      After replacing thecalliper Andrew Reed took the vehicle out for a drive to investigate, as Imentioned to him that there was a cracking noise when the vehicle was turning.He has advised me that there is a possible front wheel bearing noise and thatboth top strut bearings are cracking when turning.


      I am very concerned that agarage has been able to sell an unroad worthy vehicle, it has been found to beunsafe and was in very dangerous condition when it was sold to me. Since havingthe vehicle I have spent in excess of £1800 with more money to be spent on itto get it up to scratch. This vehicle was not fit for purpose when I bought it.

        the finance company rang me saying there were looking into the brakes and that is all.then told me its because of the car age!

        I have bought a couple of lemons in my time too, so I do feel for you. I once bought a car that came with a new MOT only to be told a few weeks down the line that both front tyres were the wrong size and illegal. Took it back to the dealer who said we had put the wrong tyres on the car just to get new ones. Bunch of crooks!

        Presuming the car was sold with a new MOT certificate? If so, who carried out the MOT? if it was the garage where you bought the car, perhaps you can "suggest" they offer a straight swap for a safe car or maybe you will have to contact the Ministry of Transport and report that they are issuing MOT Certs for their "for sale" vehicles which have turned out to be unroadworthy and unsafe....?

        Have you taken it in for Wheel Alignment? Can be done for less than £30.

        You say the garage sold an unroadworthy vehicle... but you've had the vehicle for 18 months? Hard to prove this was the case at the time of purchase.

        A lot of the problems you describe don't seem too out of order if i'm honest, this car is about 9 years old!

        You live in the middle of nowhere... i'm assuming the vehicle is used on rough terrains? Which could explain excessive wear on the suspension.

        The noise when turning.... could this be a CV joint?

        If i'm honest, it just sounds you like bought an old car and expected it to last forever maintenance free.

        sorry middle of now were means no buses, so have to have a car to get about. all normal roads. i expect to pay for an up keep on the car but nothing like this has been, yes its a old car BUT it was meant to have a full service history (which is fake) and a serivce before we got it. and it was not done.

        the car should have not been sold with the parts welded on to the brakes.

        do i keep paying for the cars up keep as with all the other bills? mot?tax? paying the finance company?

        To be honest, I think you will be very lucky indeed to have any comeback with the dealer.

        How do you know the service history is fake, and how do you know the service it was supposed to have wasn't done?

      • no comeback with the dealer at all! its the fiance company im seeing. Yes its a nine year old car, that should have not been sold.

        The history is from a garage that is made up some were in scotland. The last service the garage said it had, the garage i took it to said no work has been done and if it had been there would have found the brake parts welded togther!

        no luck in it. there are laws about this!
