Old cases csa1 moving to gross income allowance

I've been reading into this and just found out about the gross income allowance. It seems that it will start in October 2012. Will csa1 old cases be contacted in October?

My husband is on csa1. His ex has a very comfortable life, working tax free and claiming all benefits whilst her husband earns £80k+ a year. My husband is to work until Our baby is 6 months then he will become a stay at home dad when our baby is born next year as I will return to work full time. That has always been the plan and we were going to continue paying the csa for his 15 year old son as normal, even though he won't be earning.

So will we be assessed on the new scheme using his past years salary even though he won't be earning in a few months? Is my salary taken into account? We have saved for the past year so he can still continue to pay csa and be a stay at home dad.

    In a word, no, you'll not be contacted in October. When the new scheme launches initially it will just be for new cases (and even then, not all new cases, there will be certain criteria). Current cases won't be moved over until some time next year, and the first moved will be clerical cases, then old rules cases, and finally new rules cases.

I don't know how we will pay anymore than what we are doing now.

    I've read that they are to contact parents with care in Oct and non resident parents in Dec to say about the changes. then if an agreement can't be met, they start the new system.

    Am I the only one worried about this reassessment? I'm 5 months pregnant and it's worrying me sick. We've waited until we could afford a baby and afford to have my husband stay at home until we started a family. We won't be entitled to benefits because of my salary but now I'm worried we'll be hit with arrears and back pay if they recalculate.

    I'd say the chances of your case being moved over next year would be quite slim to be honest. Even if you were on the gross income scheme, if your husband wasn't earning anything then he wouldn't be expected to pay anything.

    Be aware that on the current schemes, you can be reassessed at any point, whenever either party asks for a reassessment.

    Thanks for your reply PreludeForTimeFeelers. We are aware that we can be reassessed at any time anyway but the fact that it is very likely to happen if they try to move us across next year and the new baby is all very stressful.

    If we are moved across and the contact the HMRC for wage details and it turns out we should have been paying more, what would happen if my husband wasnt working??! We don't think his wage has changed since we were reassessed 6 years ago BUT I understand that the new system doesnt allow for mortgage and pension etc which csa1 did I think. So would they back date it or start from that day of contact (in which case my husband may be off work looking after our baby by then anyway).

    I really appreciate any advice. I'm very stressed about this, as is my husband (and I don't think pregnancy hormones are helping at all!!!) :(

    The current proposal is for cases to be fully closed, and then moved over - this means that there would be no back-dating if income had changed - there'd no longer be a case to backdate. The new assessment, if it happened, would be based on your husband's circumstances at that moment in time.

    Have to ask,will there be an option to put in an application before the old cases close or are some of us going to be left with naff all for however long until they try and start a new case?

    We have no intention of stopping payment, would rather stay in the system we are but it looks like we will move eventually to the new system.     I doubt the 13 week rule would apply seeing as it's them closing cases.It's just going to be a pain for those of us who have pathetic excuses of men for exes and will have to wait however long it takes them (I can see a few nrps thinking it gives them a new chance to not bother responding too).

    Oh well,such is the CSA lol it'll take them long enough to start transferring old cases over anyway and I'll take him to court for a top-up if needed.Just a shame it's not all simple and relaxed!

    Can I just ask, if they don't backdate payments then how do people end up with arrears? I it when the case is ongoin and an assessment is made? Rather than if you lose your job and then get another reassessment based on your new situation?

    How do arrears occur? We have never missed a payment but we aren't assessed every year.

    I know they can occur through reassessment but only for the period of reassessment,as far as I'm aware.Also can occur if a departure is granted.Not sure if there are any rules surrounding DEOs that mean arrears accrue due to not informing on change of pay???
