Plasma TV - been away for repair 6 weeks, No ETA - what are my rights?

Last july I took delivery of 42" Fujitsu-Siemens Plasma TV.

Initially it was great, but then i noticed the picture started to degrade (some sparklies at the top right of the display & also skin tones took on a pink 'burn wound' look!)

In February it all got too much, so i raised a fault call. It's a two year warranty courier/collect & return to base. Fujitsu-Siemens use a third party maintenance company to fix their Plasmas

The courier came & took it away 6 weeks ago...since then i've had to chase twice with the repair company (as they weren't updating me). Each time I've been told that they're waiting on a part (display unit...ouch!) from Fujitsu-Siemens, but the worse bit is that they still have no ETA!!

How long can i be kept waiting...it's been six weeks already & with not even an ETA it could go on for months!!

I'd like a replacement or a refund - do I have a fighting chance? If so, which route should I tae towards this?

Cant remember what the details are but they only have 28 days, after that they have to swap or refund.

    Hope this helps

28 days is considered a reasonable period for repair. After this you are entitled to a replacement. Contact the retailer.

If you've chosen to use the manufacturers' warranty you are entirely bound by the terms of the warranty, as it is not the same as your statutory rights which are against the retailer.

Check the terms and see what it says.
  • I bought it from an internet retailer & at the time it was quite explicit that it was a two year manafacturer's warranty (courier/collect service). Therefore when it came to rase a fault call, I never even thought to go via the retailer.

I'll try & dig out tere terms & conditions, though I doubt it will that explicit enough to cover actual timeframes for a warranty repair turnaround, with clauses outlining what will happen if they don't meet those turnaround times?

Bit of a shame really...the raising the call was smooth as silk, the courier was excellent (ie he gave an exact time he'd be at my house, very polite/professional, inspected the TV for damage, marked a sheet in duplicate accordingly etc, etc)...it's just gone a bit pear shaped with the sourcing of spare parts.
