Maritime carpark Falmouth

I know this has been covered but would like to vent my anger. I have been issued a ticket by Armtrac Security Services which i have replied to using a template found on this site stating that i refuse to pay as 'The alleged contravention did not occur'. The ticket was issued at 14:05 but had blown over when i shut the door. I returned to the car with 50 mins remaining on the ticket, saw the charge and spoke to the women who issued it but, as you all have guessed, she refused to discuss it. While i was talking to her three other people came over with the same complaint, she refused to speak to any of us.
The letter i recieved back from Amrtrac stated my 'Appeal' was not successfull and that the matter was closed as long as i pay them £80. I have no intention of paying but feel like writing back to tell them that i wasn't appealling but refusing to pay.
As a side note, do the balifs ever turn up at your door or do they generally issue letters? My wife is on maternity leave and i wouldn't want her hassled by some goon.
As a side side note, at the time i spoke to a lady at Armtrac who advised not to pay the £5 admin charge as they wouldn't chase for it and i also spoke to the BPA, who off the record, said that i didn't have to pay the charge.

    They cannot send bailiffs. They would first need to take you to court, get a judgement against you, and then you still refuse to pay.

  • Consider yourself "vented".

    Don't bother communicating with them any more. They automatically
    (a) interpret any initial communication as an appeal, no matter what the content
    (b) reject it anyway.

    Just ignore them from now on. No-one will turn up at your door. It's just letters, and maybe phone calls if it gets passed to a Debt Collection Agency (not as scary as it sounds, as they have zero powers to do anything, they're not an official body of any sort). (Real) bailiffs don't even come into the picture until you've been taken to court (which they won't do), win (which simply wouldn't happen) and then you refused to pay up what the judge stated. You'll probably be holidaying on the moon before that happens.

    The final but more unpleasant threats usually include mentioning that, if the case goes to court, a county court judgement (CCJ) may be issued, that bailiffs may be appointed and that your credit rating may be ruined. For things to actually get to this stage, the car park owner would have to take you to court and win the case. Then, you would have to refuse to pay, to get a CCJ issued after 28 days. Then, you would have to still refuse to pay, to get bailiffs appointed.
    The acquisition of wealth is no longer the driving force in my life. :)

    Armtrac are still at it! I could very well have written the first post in this thread....
    Parked in the maritime carpark in Falmouth a couple of weeks back and bought a ticket, got my 18month old daughter out of the van in a right strop and put the ticket in the window of my van. Went for lunch and came back to find a fixed penalty stuck to my van.
    On looking I found that the ticket I had bought was now upside down about 3cms away from where I had out it.
    I've appealed, which has been rejected (surprise) but did point out a couple of other things such as the reference number on the ticket is the same on both sides so the photo they have of the ticket upside down in the dash is the same as the one I have retained as evidence - proof of actually paying legitimately for parking.
    The letter I received back was comical. Obnoxious in it's content, and actually a little offensive. I've already been told they will be going for debt recovery and that I can appeal to the POLPA if i wish. If I can get a copy of it on here I will!
    Anyone else had any recent dealings with them (armtrac) and has anything changed with regards to how we should be dealing with back?
    I don't fancy going to court incase I get landed with huge costs, but £100 for a parking fine is just ridiculous!!!!!
